Care of the islands located on Summerfield Avenue and on <br />Meadow Way Trail and acquisition and maintenance of facilities <br />and equipment necessary to provide water for the care of such <br />islands; and <br />d. Other maintenance necessary or desirable, in the discretion of the <br />Association in regard to shrubs, vegetation or grass on Lots <br />contained within the Properties or any drainage ditch contained <br />within the Properties. <br />The Association is specifically authorized hereunder to contract with any third party to <br />manage the Properties or provide maintenance as provided herein. <br />In the event that any maintenance or repair is caused through the willful or negligent act <br />of any Owner, his or her family, guest or invitees, the cost of such maintenance shall be promptly <br />paid by such Owner. <br />The Association may, upon request from and with the written consent of any Owner, <br />contract to have various maintenance or repair items performed for such Owner. Any <br />maintenance or repair items so performed shall be the obligation of such Owner and not the <br />obligation of the Association and such Owner shall promptly pay for any maintenance or repair <br />items so performed. <br />6. Each Owner of any Lot contained within the Properties shall maintain insurance <br />on the buildings and improvements located on such Lot in an amount not less than the <br />replacement value of such buildings and improvements and provide proof of such insurance to <br />the Association. Each such Owner take all action necessary so that any company providing such <br />insurance shall notify the Association in the event of cancellation of such insurance and this <br />Article III., Paragraph 6. shall constitute the consent of any such Owner for any such company <br />providing such insurance to include within such insurance coverage provisions for notice of <br />cancellation of such insurance to be provided directly to the Association. All insurance proceeds <br />shall be applied toward repairing the damages suffered. In case the insurance proceeds are less <br />that the cost of repairs, the excess cost shall be paid by the Owner of such Lot. All damaged <br />structures shall be rebuilt and/or replaced. At the option of the Association, the Owner of any <br />Lot within the Properties shall take all action necessary so that any company providing such <br />insurance shall include within such insurance coverage an appropriate loss payable clause <br />naming the Association as payee of insurance proceeds and this Article III., Paragraph 6. shall <br />constitute the consent of any such Owner for any such company providing such insurance to <br />include within such insurance coverage provisions for an appropriate loss payable clause naming <br />the Association as payee of insurance proceeds. Upon receipt of any insurance proceeds <br />hereunder, the Association shall deposit such insurance proceeds for the benefit of the Owner <br />and disburse such insurance proceeds directly toward repairing the damages suffered. The <br />Association shall have the right to purchase insurance on the buildings and improvements <br />located on any Lot contained within the Properties if the Owner of such Lot does not purchase <br />such insurance consistent with the terms of this Article III., Paragraph 6. The costs of any such <br />insurance purchased by the Association shall be an assessment against such Lots and such <br />assessments, together with interest, costs and reasonable attorneys' fees shall be and constitute, <br />
