201903152 <br />b. the amount of all charges which are the legal obligation of tenants and <br />which would otherwise be the obligation of Borrower; and <br />c. the fair rental value of any portion of the Project which is occupied by <br />Borrower. <br />10. Six (6) months business interruption (loss of rents) insurance in an amount <br />acceptable to Lender. <br />II. LIABILITY INSURANCE <br />An ORIGINAL CERTIFICATE or other evidence (e.g. an ACORD 27 certificate) of <br />General Comprehensive Public Liability Insurance naming Borrowers as an insured, <br />and written by a carrier approved by Lender with a current Best's Insurance Guide <br />Rating of at least A -IX (which is authorized to do business in Nebraska) that includes: <br />1. $2 million combined single limit coverage. <br />2. Additional Insured Endorsement naming Lender. <br />3. 30 -day notice to Lender in the event of cancellation, non -renewal or material <br />change. <br />III. WORKER'S COMPENSATION <br />An ORIGINAL CERTIFICATE of Worker's Compensation coverage in the statutory <br />amount, naming Borrower as owner of the Project, written by a carrier approved by <br />Lender. <br />IV. OTHER <br />All insurance provided for in this Exhibit shall be effected under a valid and <br />enforceable policy or policies of insurance in form and substance approved by Lender, shall <br />be issued by insurers of recognized responsibility, which are licensed to do business in <br />Nebraska, and which are acceptable to Lender, and shall be satisfactory to Lender in all other <br />respects. <br />The certificates of insurance for property, liability and builder's risk must comply with <br />the following: <br />1. ACORD 25-S forms (titled "Certificate of Insurance") for liability ARE <br />UNACCEPTABLE unless modified to a) indicate that the insurance is in force and 2) <br />provide for 30 days written notice to the Lender of intent to cancel the insurance. This <br />modification will occur in the bottom right of the form. The Lender does not accept <br />standard ACORD 25-S forms as they are "issued as a matter of information only and <br />confer no rights," and do not certify the existence of the insurance and do not promise <br />notice to the Lender prior to cancellation. <br />2. An ACORD 27 (titled "Evidence of Property Insurance") relates to property insurance <br />and is acceptable (but see 4, below). Although an ACORD 27 is not on its face to be <br />used to evidence policies of liability insurance, it is adaptable to that purpose, and is <br />acceptable if so adapted. <br />32 <br />
