201902922 <br />21. The lakes in the subdivision are potentially dangerous. Each owner of a lot in the <br />subdivision acknowledges this fact and agrees for himself, his family, his guests and invitees to use the <br />lakes in a safe and prudent manner. The owner of the lakes including all members of Meadowlark Estates <br />Homeowner's Association, LLC shall not be liable for any injury, death or damage which may result to <br />persons using the lakes or any of the common area. Rules with regard to fishing, hunting, and boating on <br />Lot Twelve (12) shall be as follows: <br />A. FISHING <br />North Lake and South Lake: Fishing laws of The State of Nebraska shall be observed. <br />B. HUNTING <br />No pheasant, quail or waterfowl shall be shot at, disturbed or taken. <br />C. BOATING <br />North Lake and South Lake: Sail and power boats may be used subject to restrictions imposed <br />by Meadowlark Estates Homeowner's Association, LLC. <br />Other regulations pertaining to the use of Lot Twelve (12) and the lakes thereon may be adopted by the <br />members of Meadowlark Estates Homeowner's Association, LLC, and shall be binding upon the owners <br />of all lots in the subdivision. <br />22. These restrictive covenants shall run with the land and shall be binding upon all persons <br />and parties claiming ownership of lots in the subdivision until changed or modified by all of the lot <br />owners in said subdivision. <br />23. If any owner of any lot or his heirs or assigns shall violate or attempt to violate any of the <br />restrictive covenants herein set forth, it shall be lawful for any other person owning real estate in said <br />subdivision to prosecute such proceedings at law or in equity against the person or persons violating or <br />attempting to violate any such covenants, and to prevent him from such violation or to recover damages <br />for such violations. <br />24. If any covenant or portion thereof is declared unlawful or void by a court of competent <br />jurisdiction, the remaining covenants, or portions thereof, shall not be affected, but shall remain in full <br />force and effect. <br />4 <br />
