201902922 21. The lakes in the subdivision are potentially dangerous. Each owner of a lot in the subdivision acknowledges this fact and agrees for himself, his family, his guests and invitees to use the lakes in a safe and prudent manner. The owner of the lakes including all members of Meadowlark Estates Homeowner's Association, LLC shall not be liable for any injury, death or damage which may result to persons using the lakes or any of the common area. Rules with regard to fishing, hunting, and boating on Lot Twelve (12) shall be as follows: A. FISHING North Lake and South Lake: Fishing laws of The State of Nebraska shall be observed. B. HUNTING No pheasant, quail or waterfowl shall be shot at, disturbed or taken. C. BOATING North Lake and South Lake: Sail and power boats may be used subject to restrictions imposed by Meadowlark Estates Homeowner's Association, LLC. Other regulations pertaining to the use of Lot Twelve (12) and the lakes thereon may be adopted by the members of Meadowlark Estates Homeowner's Association, LLC, and shall be binding upon the owners of all lots in the subdivision. 22. These restrictive covenants shall run with the land and shall be binding upon all persons and parties claiming ownership of lots in the subdivision until changed or modified by all of the lot owners in said subdivision. 23. If any owner of any lot or his heirs or assigns shall violate or attempt to violate any of the restrictive covenants herein set forth, it shall be lawful for any other person owning real estate in said subdivision to prosecute such proceedings at law or in equity against the person or persons violating or attempting to violate any such covenants, and to prevent him from such violation or to recover damages for such violations. 24. If any covenant or portion thereof is declared unlawful or void by a court of competent jurisdiction, the remaining covenants, or portions thereof, shall not be affected, but shall remain in full force and effect. 4
