201902922 <br />16. As shown on the plat of the subdivision, a sixteen (16) foot wide easement has been <br />platted and dedicated for utility purposes. The easement area shall also be used for an access road in <br />order to provide ingress and egress to each lot from the county road. Since the easement is located on Lot <br />Twelve (12), the owner of said lot, namely, Meadowlark Estates Homeowner's Association, LLC. shall <br />permit the owner of each lot, and his invitees, to travel on the easement area for road purposes, without <br />interference The owners and Meadowlark Estates Homeowner's Association, LLC also grant to all lot <br />owners and their invitees, an unrestricted right to use the easement which connects the access road in the <br />Northeast corner of the subdivision with the County road on the East, said Amendment 78-00176 and <br />easement recorded as Document #77-005302. <br />17. Lot Twelve (12) in the subdivision contains the lakes and common area. Title to said lot <br />shall be vested in Meadowlark Estates Homeowner's Association, LLC formed by the owners. Each <br />person or entity that purchases a lot in the subdivision shall, at the same time, become a member in <br />Meadowlark Estates Homeowner's Association, LLC. The membership shall entitle the lot owner, their <br />family, guests and invitees to use the lakes and common area for recreational purposes. Membership in <br />Meadowlark Estates Homeowner's Association, LLC, cannot be held by any person or entity that does <br />not own a lot in the subdivision. Upon sale of a lot, the members shall automatically be transferred on the <br />books of the company to the new owner. <br />18. Meadowlark Estates Homeowner's Association, LLC, Inc. (the company) shall be a <br />homeowner's association for the purpose of owning, preserving, improving and maintaining Lot Twelve <br />(12) of the subdivision, the lakes thereon and the access roads. The company shall bear all costs of <br />maintaining Lot Twelve (12), which includes the following: Payment of real estate taxes on Lot Twelve <br />(12), maintenance of the access roads in and to the subdivision snow removal on the access roads <br />maintenance of the lakes and common areas in Lot Twelve (12), and payment of all other expenses <br />which are involved in maintaining and preserving Lot Twelve (12). <br />19. To raise funds for the above expenses, the members of the association shall have the <br />authority by resolution to establish a schedule of dues and assessments which shall be levied equally on <br />each lot and which shall be paid annually or at such other time as called for in the resolution. Failure to <br />pay dues or assessments when specified shall, without further notice or action, cause the owner, his <br />family, guests, and invitees to be prohibited from using the lakes and common area in Lot Twelve (12), <br />and the members may proceed with whatever legal action is necessary to impress a lien upon the owner's <br />lot, and to foreclose said lien in the same manner as the foreclosure of a mortgage. <br />20. For Meadowlark Estates Homeowner's Association, LLC voting purposes, each member <br />shall be entitled to one vote. Only one membership may be issued for each lot. All action by members <br />shall require the affirmative vote of the members holding a majority of the membership except that the <br />following action of the company shall require the unanimous vote of members owning the eleven (11) <br />residential lots: <br />A. Construction of recreational facilities or other improvements on Lot Twelve (12). <br />B. Construction of water and sewer lines by the company. <br />C. Purchase of additional land for attachment to Lot Twelve (12). <br />D. Sale or further subdivision of any part of Lot Twelve (12). <br />E. Mortgaging or encumbering any portion of Lot Twelve (12). <br />F. Dissolving the Meadowlark Estates Homeowner's Association, LLC. <br />3 <br />
