201901777 <br />21. To expend or distribute my income or principal for the support, education, care or <br />benefit of me and my dependents; <br />22. To continue with any gifting program I may have commenced, with the right to <br />make periodic gifts of any ofmy property, outright or in trust, to or for the benefit of all or aportion <br />of the members of a class consisting ofmy spouse and my issue who are now or hereafter living, <br />including tansfers to my Agent, provided the property transferred to any done, other than my <br />spouse, in a calendar year shall not exceed a value equal to the amount of the annual exclusion for <br />gifts of present interest allowed under the Federal Tax Code; my Agent may, on my behalf, <br />renounce and disclaim any or all of my interest in any estate or interest to which I may succeed, <br />including a power of appointment; I also give to my Agent the authority to gift or otherwise <br />transfer all or any portion ofmy assets, real or personal, to my spouse, even in the event my spouse <br />is my Agent, pursuant to rules permitting such transfers when qualifying me to receive Medicaid <br />or other government benefits to which I may be entitled; <br />23. To make transfers of any tangible property, intangible property, or money, without <br />consideration, to anyone (including my Agent and any persons to whom my Agent owes an <br />obligation of support), as may be deemed proper by my Agent; <br />24. To reimburse my Agent for alI expenses paid on my behalf from my Agent's <br />personal fiords; and further, my Agent shall be entitled to receive reasonable compensation for <br />acting under this Power of Attorney on my behalf, which compensation shall be paid from my <br />assets by my Agent; <br />25. To provide for my health and physical welfare and well-being in such manner as <br />my Agent deerns proper, and in connection therewith to arrange for and give written consent to <br />medical, surgical and other procedures, hospitalization and admission to any hospital, nursing <br />home, health center, convalescent home, retirement home, or similar facility; <br />26. To assign, transfer and convey to the trustee of my trust heretofore or hereafter <br />establish by me, or to the trustee's nominee, any and all property owned by me, including real <br />estate, and to sign and deliver any instruments necessary or desirable in connection with such <br />assignment, transfer or conveyance; and if authorized by me in paragraph 30 below, to exercise <br />the power of revoca+ion and revoke any revocable trust heretofore or hereafter established by me; <br />27. To apply for and receive any government, insurance and retirement benefits to <br />which I may be entitled; and <br />28. Without in any wise limiting the foregoing, generally to do, execute, and perform <br />at any other act, deed, matter or thing whatsoever that ought to be done, executed and performed <br />or that in the opinion ofmy said Agent ought to be done, executed or performed, in and about the <br />premises, of every nature and kind of whatsoever, as fully effectually as I could do if personally <br />present. <br />29. In the event it is determined by my Agent that I am in need of a guardian and/or <br />conservator, I hereby nominate my Agent in fact to become such, and I authorize my Agent to <br />make application in my name to seek a voluntary appointment of a guardian and/or conservator <br />for me; no such guardian and/or conservator so nominated by me shall be required to furnish or <br />give any bond or security for the faithful performance of their duty. <br />30. This Power of Attorney shall become immediately effective upon my disability or <br />incompetency as determined by my physician, but shall not be effective for any purpose prior <br />thereto. <br />31. Pursuant to the provisions of Sections 30-4010 of the Nebraska *Uniform Power of <br />Attorney Act, I declare that this Power of Attorney shall not be affected by my subsequent <br />disability or incapacity, and that the authority granted herein shall continue during any period while <br />I am disabled or incapacitated.
