201807794 5. Pursuant to ARTICLE VII of the Last Will and Testament of Robert G. Wenzl, Reburta R. Wenzl and Heritage Bank were designated as Co -Trustees of all trusts created under said Last Will and Testament with a further provision that in the event Reburta R. Wenzl should be unable or unwilling to serve or to continue to serve as Co -Trustee Heritage Bank shall be permitted to serve as sole Trustee without necessity of replacement; 6. At ARTICLE VI of the Last Will and Testament of Robert G. Wenzl, the Robert G. Wenzl Family Trust was created ("Family Trust") wherein under date of June 17, 2016, Reburta R. Wenzl and Heritage Bank executed an Acceptance of Co -Trusteeship wherein they accepted the Co -Trusteeship of the Robert G. Wenzl Family Trust; 7. Reburta R. Wenzl died on April 21, 2018; 8. From the date of the creation of the Family Trust until April 21, 2018, Affiant has served as a Co -Trustee of the Family Trust with Reburta R. Wenzl and due to the death of Reburta R. Wenzl on April 21, 2018 and pursuant to ARTICLE VII of the Last Will and Testament of Robert G. Wenzl, Affiant continues to serve as sole Trustee of the Family Trust: 9. The terms of the Family Trust grant the Affiant as sole Trustee all powers under the Nebraska Uniform Trust code, including the power to sell real estate; 10. The Internal Revenue Service has issued a taxpayer identification number for the Robert G. Wenzl Family Trust; 11. Rebecca Rae Weber, Sherryl Ann Johnson, Katherine Kay Wortman, William Edward Wenzl, Robert Ray Wenzl, Pamela Sue Farber, Mark Eilts and Katherine Mitchell are the beneficiaries of the Family Trust; and 12. Affiant states that (a) there are presently and have been since the inception of the Family Trust no other trustees appointed to serve on behalf of the Family Trust; (b) that Affiant is the sole Trustee at this time, and (c) the Family Trust has not been revoked, subsequently amended or terminated and is in full force and effect.
