F <br />$g-- 103440 <br />Inconsistent with the provisions of this article, the general rules of law <br />regarding party walls and liability for property damage due to negligence or <br />willful acts or omissions shall apply thereof. <br />2. The party wall shall be constructed in a workmanlike manner by <br />David Le Larson under the following specifications: <br />(a) Foundation and Footing: 20" wide footings, 10" x.81 poured <br />concrete. <br />(b) Interior Wall: two separate 2 x 4 wallss, one inch apart, with <br />5 /8ths inch sheet rock running to the roof sheathing. <br />3. Should such gall be damaged or destroyed by the faultp negligence <br />or other act or omission of one of the parties, such party shall rebuild or <br />repair the wall and shall compensate the other party for any damages to the <br />property of the outer party. Should the Wall be damaged by any cause other <br />than the act, omission or default of either. party, the wall shall, be• repaired <br />car rebuilt- at their joint expense, provided that any such payment received <br />from insurance for such damage or destruction to the Wall shall first be <br />spplied to such repair or restoration. <br />4. This Agreement shall be perpetual in effect and shall continue as <br />an easeeiaht and a covenant- Punning with' the land provided, however. that <br />nothing herein contained shall be �wp3trued as a conveyance by either party of <br />their rvspe3ctive rights in the fe4`of the" lot on which the wall shall stand. <br />:;This Agreement rshall bind and iriu,re to the benefit of the respective. heirs, <br />"successorst personal representatives and assigns of the <br />parties. <br />S.
