201807114 <br />revoke any of the Trusts established under the terms and provisions of the Trust <br />Agreement. <br />5. That under the terms and provisions of the Trust Agreement, Janet M. <br />Warner is nominated as the first successor Trustee of each separate Trust established <br />under the Trust Agreement; that Janet M. Warner (hereinafter "Warner") has accepted all <br />separate Trusts established under the terms and provisions of the Trust Agreement; and <br />Warner is currently acting as the sole and only Trustee of all Trusts established under the <br />terms and provisions of the Trust Agreement. <br />6. The powers of the Trustee and any restrictions imposed upon the Trustee <br />in dealing with the assets of the Trust under the Trust Agreement are set forth in the Trust <br />Agreement and are attached hereto as Exhibit "A". <br />7. The terms of the Trust Agreement provide that a third party may rely on <br />this Certification of Trust as evidence of the existence of the Trust, and is specifically <br />relieved of any obligation to inquire into the terms of the Trust or the authority of the <br />Trustee, or to see to the application that the Trustee may make of funds or other property <br />received by the Trustee. <br />8. The Trust Agreement sets forth the name or method of choosing successor <br />Trustees; and specifically states that any Trustee shall have the right to resign at any time <br />by giving notice in writing to the current income beneficiaries of the trust at least thirty <br />(30) days in advance of the effective date of said resignation. In the event that Warner is <br />unable or unwilling to serve as Trustee, then Michael J. Dowd shall automatically be <br />appointed as the second successor Trustee of each separate Trust established under the <br />Trust Agreement upon acceptance of such Trust by Michael J. Dowd.
