To exercise the Power of Sale, the Successor Trustee references this procedure: <br />a) Lender - Beneficiary, and the Trustee, has given the Borrower - Trustor a "Notice" in the <br />form of a declaration of default; even though the DOT does not specifically require any notice <br />given to the Borrower in the event of a default — other than this statutory notice required by <br />Neb. Rev. Stat. 76 -1012. <br />b) The Borrower - Trustor has the right of reinstatement, as specified in Neb.Rev.Stat. 76- <br />1012, to cure what is "due under the terms of such trust deed and the obligations secured thereby <br />including costs and expenses actually incurred in enforcing the terms of such obligation ", <br />whereupon a reinstatement could occur. <br />c) Having now invoked the power of sale, the Trustee hereby gives record Notice of the <br />Trustor's default by filing this NOD. <br />4. Federal Fair Debt Collection Practices Act (FDCPA): To satisfy the requirements of <br />the FDCPA, Section 1692(g), this specific information is given: The amount of the debt is <br />$152,121.19. The name of the creditor to whom the debt is owed is Phyllis J. Codner Revocable <br />Trust. Unless, within 30 days after the Trustor receives this NOD, you (Trustor) dispute this <br />validity of the debt, or any portion thereof, the Trustee and Beneficiary will assume the debt to <br />the valid. If the Trustor, within 30 days after receipt of this NOD, notifies the <br />Trustee /Beneficiary that the debt is disputed, or any portion of it, then the Trustee/Beneficiary <br />will obtain verification of the debt and mail to the Trustor a copy of that verification. If, within <br />30 days after the receipt of this NOD, the Trustor so requests in writing, the Trustee/Beneficiary <br />will provide the Trustor with the name and address of the original creditor if different from the <br />current creditor. <br />5. Mailing: This NOD will be mailed, not later than 10 days after the recording of this <br />NOD, by either registered or certified mail with postage prepaid, with a copy of the Notice <br />showing the recording date thereon; this Notice may be a conformed copy to the one actually <br />placed of record. This Notice shall be addressed to each person whose name and address is set <br />forth on the DOT, to include any who might have requested Notice in a record filing. Notice to <br />the Trustor will specifically be given to Julio O. Matul Hernandez and Irma Matul Gonzalez, <br />husband and wife, 219 East 7th St., Grand Island, Nebraska 68801, which is the only address <br />furnished to the Trustee as referenced in the DOT. <br />
