NOTICE OF DEFAULT <br />THIS NOTICE OF DEFAULT is given according to the general authority ofNeb.Rev.Stat. 76- <br />1006 and the Deed of Trust (DOT) now in default, which DOT is referred to in this Notice: <br />1. The Deed of Trust is: Dated October 3, 2006. Trustor Julio O. Matul Hernandez and <br />Irma Matul Gonzalez, husband and wife, Successor Trustee David C. Huston. Beneficiary <br />Phyllis J. Codner Revocable Trust. This DOT, is recorded in Instrument Book 200608939. <br />2. The particulars necessary to the exercise the power of sale written into the DOT referred <br />to, above, is: <br />a) A breach of the obligation for which the trust property was conveyed as security has <br />occurred. <br />b) The beneficiary has elected to declare the entire amount of the Promissory Note, which is <br />secured by the DOT, herein, due and payable at once. The nature of the breach of the obligation <br />secured by the DOT is the failure of the Trustors: "to pay an installment of principal or interest <br />or any other sum secured hereby when due ". Specifically, to pay installment payments of <br />principal and interest and taxes and insurance. Given these defaults the Successor Trustee, as <br />instructed by the Beneficiary, has elected to "sell the Trustor's interest in the property and the <br />proceeds thereof to be distributed, all in the manner provided for in the Nebraska Trust Deeds <br />Act" <br />c) The Trust property is not known to be used in farming operations carried on by the <br />Trustor. <br />20180566 <br />d) The Trustor's default may be cured within 1 month of the filing for record of this NOD <br />and, if the Trustor does that, then the obligation in the trust deed may be reinstated as provided in <br />the DOT and in Neb.Rev.Stat. 76 -1012. <br />e) Expenses of the Trustee to the date of any reinstatement, to include attorney's fees - <br />provided in the DOT and/or Neb.Rev.Stat. 76 -1012 - apply and are assessed, together with costs <br />of any title evidence. These amounts, together with the total of the obligation owed by the <br />Trustor as expressed in this NOD, shall be given by the Trustee upon request. <br />f) After the lapse of not less than 1 month after the filing of this NOD, the Trustee shall <br />then give Notice of Sale as provided in Neb.Rev.Stat. 76 -1007. <br />g) This NOD shall be filed for record in the office of the Register of Deeds of Hall County, <br />Nebraska, the only county in which the trust property is located; and, this instrument shall be <br />indexed and recorded against the subject real property which is: <br />Lot Two (2), Block Five (5), Original Town, now City of Grand Island, Hall County, <br />Nebraska. <br />
