WHEREAS, Bank is willing to consent to said assumption and release Jeremiah J. <br />Kaspar (Original Borrower) from liability under the Note and Deed of Trust; <br />NOW, THEREFORE, THE PARITIES HERETO HEREBY AGREE AS FOLLOWS :: <br />1. The above recitals are incorporated herein by this reference. <br />2. New Borrower hereby unconditionally assumes the Note and Deed of Trust and agrees to <br />become fully liable and responsible for the debt and all other obligations set forth therein as if <br />New Borrower were the original maker and obligor of the Note and Deed of Trust. <br />3. Bank hereby consents to said Assumption and hereby releases Jeremiah J. Kaspar <br />(Original Borrower) from liability under the Note and Deed of Trust from and after the date of <br />this Agreement. <br />4. Nothing in this Agreement shall affect or be construed to affect in any way the Note, <br />Deed of Trust or lien created by Jeremiah J. Kaspar and Jennifer L. Kaspar (Original Borrowers) <br />which shall remain in full force and effect and enforceable against Jennifer L. Cook formerly <br />known as Jennifer L. Kaspar (New Borrower) in accordance with their terms. <br />5. Notwithstanding Bank's consent to New Borrower's assumption of the Note and Deed of <br />Trust, such consent in no way constitutes a waiver of Bank's rights with respect to future <br />assumptions which shall require Bank's written consent. <br />6. New Borrower agrees to execute such other documents as Bank may require to document <br />the assumption and to more fully implement the provisions of this Agreement. <br />7.
