Trust; <br />73 (In <br />rn XI <br />I. <br />rnnvi <br />flvt•• <br />li m <br />9.) <br />r <br />w <br />ASSUMPTION AGREEMENT WITH RELEASE OF LIABILITY <br />THIS ASSUMPTION AGREEMENT WITH RELEASE OF LIABILITY ( "Agreement") <br />is made by and between West Gate Bank ("Bank") and Jennifer L. Cook, formerly known as <br />Jennifer L. Kaspar ( "New Borrower"). <br />WHEREAS, Jeremiah J. Kaspar and Jennifer L. Kaspar ( "Original Borrowers ") were the <br />makers and obligor of a certain Note dated September 24, 2012, in the original principal amount <br />of $178,100.00 (the "Note "), the terms and conditions of which are incorporated herein by this <br />reference; <br />WHEREAS, as security for the repayment of the Note, Original Borrowers executed a <br />mortgage, Deed of Trust or other security instrument of even date with the Note which is filed of <br />record as follows; October 4, 2012, as Instrument #201208276, Assignment to West Gate Bank <br />which is filed of record as follows. October 4, 2012, as Instrument #201208278 (the <br />"Mortgage "), the terms and conditions of which are incorporated herein by this reference; <br />WHEREAS, the Deed of Trust constitutes a first lien in and to the real estate identified as <br />(the "Property"); <br />LOT ONE (1), BLOCK TWO (2), WOODLAND PARK FIRST SUBDIVISION, GRAND <br />ISLAND, HALL COUNTY, NEBRASKA <br />WHEREAS, Bank is the current holder of the Note and is servicing the Note and Deed of <br />WHEREAS, New Borrower is duly and legally occupying the Property and has read the <br />Note and Deed of Trust and understands all of the obligations set forth therein; <br />WHEREAS, New Borrower desires to become a maker and obligor of the Note and <br />assume all of the obligations set forth in the Note and Deed of Trust which are current and have <br />been fully complied with as of the date of this Agreement; <br />rn <br />t+1 <br />rn <br />o � <br />tin <br />OD <br />cD Lel <br />—r: f <br />Cr) <br />CA <br />rri <br />CD <br />06 <br />
