2. Section 5 of the Agreement is amended to read as follows: "The Subdivider agrees that no vehicular <br />ingress /egress access to Tract "A" shall be allowed directly from 13th Street except within the eastern-most two <br />hundred feet (200') of Tract "A" adjacent to 13th Street, and to and from North Road except within the <br />northern-most fifty feet (50') of Tract "A" adjacent to North Road. Ingress /egress access from 13th Street and <br />from North Road to Tract "A" shall be subject to approval of the Public Works Director. <br />3. Subdivider hereby gives, grants, and conveys to City a Temporary construction easement upon the real <br />estate described in Exhibit `B ", attached hereto, to be occupied by City for the purpose of constructing a <br />vehicular traffic roundabout at the intersection of North Road and Thirteenth Street; City shall surrender <br />possession of the premises upon completion of the construction thereof, and leave the premises substantially <br />the same as it was on the date of this agreement. <br />4. In consideration of the dedication of Right -of -Way, grant of temporary easement, and restrictions on <br />ingress and egress provided herein and hereby, City shall pay Twenty -nine Thousand Two Hundred Eighty - <br />seven Dollars and Fifty -four Cents ($29,287.54) to Subdivider within 30 days of City's approval of this <br />instrument. <br />5.
