Plans for the design and development of Lot 1, including <br />architectural and construction plans for the Hospital and grounds, have been <br />approved by Declarant and shall be deemed approved under this Declaration. <br />c. Approval of Plans. Plans for any building, parking area, sidewalk, or <br />other temporary or permanent exterior improvement, including advertising devices <br />signage, lighting, fences, exterior remodeling, color scheme, glass color, <br />reconstruction or additions, shall be submitted to the Architectural Committee <br />and shall show the design, size and exterior material for the roof, building or <br />improvement, the plot plan and landscape plan for the Lot. One set of the <br />approved plans ( "Plans ") shall be on permanent file with the Architectural <br />Committee. Construction of the building or improvement shall not be commenced <br />unless written approval of the Plans has been secured from the Architectural <br />Committee. The Architectural Committee shall have the exclusive right to <br />disapprove the Plans, if in the Architectural Committee's reasonable discretion, the <br />Plans do not conform to the Development Guidelines set forth in paragraph 2 <br />below, would adversely affect the aesthetic appearance of the Subdivision, or <br />would adversely affect the use and enjoyment of another Lot. In the event the <br />Architectural Committee fails to give written approval or disapproval within thirty <br />(30) days after receipt of the Plans, the Plans shall be deemed to be approved. <br />Upon disapproval, a written statement of the grounds for disapproval shall be <br />provided by Architectural Committee. <br />d. Variances. The Architectural Committee is hereby authorized and <br />empowered to grant variances for improvements or uses within the Subdivision <br />prohibited or regulated by this Declaration or the Development Guidelines and <br />further to grant reasonable requests for relief from the provisions of this <br />Declaration, or any portion hereof, in order to overcome practical difficulties and to <br />prevent unnecessary hardship in the application of the provisions contained <br />herein. Notwithstanding the foregoing, the Architectural Committee shall not <br />grant such a variance to any Owner unless: <br />i. such Owner has obtained all necessary governmental <br />approvals; <br />ii. the proposed construction of improvements or uses for which <br />the variance is being requested shall be consistent in design, <br />character, appearance and quality of construction with the <br />other Improvements and uses in the Subdivision, provided that <br />customary hospital- related signage shall be permitted; <br />iii. the variances do not materially injure, in the judgment of the <br />Architectural Committee, any of the Lots or Improvements <br />within the Subdivision; <br />iv. the variances do not violate any exclusive use rights granted to <br />any other Owner within the Subdivision; and <br />
