1. Architectural Control. a. Architectural Committee. 2 201802007 Committee Composition. An Architectural Committee shall be organized by the Declarant and shall consist of three (3) persons. There may also be two (2) alternate members to be designated by the Declarant at its sole discretion to act as a substitute for any member of the Architectural Committee in the event of his or her unavailability or disability. ii. Appointment. The members of the Architectural Committee shall be selected as follows: a. The owner of Lot 1, Prairie Commons Subdivision, Grand Island, Hall County, Nebraska ( "Hospital Lot ") shall the right to appoint and remove one (1) designated member of the Architectural Committee (the "Hospital Committee Member "). Provided, the special appointment provisions relating to the Hospital Committee Member set forth herein shall terminate at any time the Hospital Lot ceases to be operated as a hospital. b. Until the expiration of the Period of Declarant Control (defined below), Declarant shall have the right to appoint and remove all members and alternate members of the Architectural Committee except for the Hospital Committee Member. The Declarant may temporarily or permanently relinquish its right to appoint all or some of the Architectural Committee members and alternates at any time prior to the expiration of the Period of Declarant Control. c. Upon the expiration of the Period of Declarant Control, the Association (defined below) through its Board shall, without further act or deed of the Declarant, exercise all rights of Declarant provided herein to appoint and remove members and alternate members of the Architectural Committee except for the Hospital Committee Member, to enforce and implement the Development Guidelines and to perform Declarant's obligations under this Declaration and at such time, all obligations of Declarant under this Declaration shall automatically terminate, and except as otherwise provided herein, all rights and obligations of Declarant under this Declaration shall vest in the Board.
