c. Temporary Structures. No partially completed or temporary building and no trailer, tents, shack or garage on any Lot within the Subdivision shall be used as either a temporary or permanent place of business, other than as a temporary construction office or temporary equipment storage during the construction period described in Section 2.a. of this Declaration. 10 201802007 i. Commercial broadcast towers or free standing cell towers, but excluding communications systems required for hospital use or operations; ii. Sexually oriented businesses; iii. Any use that involves a noxious odor, excessive emission of smoke, steam, or vapor, an excessive noise level, or vibration; iv. Agricultural uses, including animal husbandry, commercial breeding businesses or feed lots; v. Auto wrecking and salvage; junk yards; storage or wrecking yards; or recycling operations; vi. Industrial or manufacturing uses; vii. Other than the operator of the Hospital on the Hospital Lot, who is not prohibited from such uses, any inpatient or outpatient healthcare services which are in direct competition with the healthcare services provided by the Hospital; an ambulatory surgical center; a dialysis center; rehabilitation services, including, but not limited to, physical, occupational and speech therapy; diagnostic imaging services; clinical laboratory and pathology services; and home health services, including hospice and durable medical equipment. Such Prohibited Uses may be waived by the mutual written agreement of the Declarant and the owner of the Hospital Lot. viii. Retail tobacco, tattoo, liquor, pay -day loan/check- cashing, or gaming /lottery /gambling establishments; or vi. Any use that is contrary to law or violates any part of this Declaration. b. Exclusive Uses. No Nebraska - licensed hospital or hospital -owned facility shall be constructed and /or operated on any lot other than the Hospital Lot. 5. Prairie Commons Association. a. Association; Membership. Prior to the expiration of the Period of Declarant Control, Declarant shall establish a business owners association for the Subdivision (the "Association ") to assist in governing the Subdivision and enforcing this Declaration. The Association may be established as a Nebraska nonprofit corporation or an unincorporated association. The form of bylaws and other organizational documents for the Association shall be reviewed and approved by a majority of all non - Declarant Lot Owners in the Subdivision at the time of the formation of the Association.
