c. Temporary Structures. No partially completed or temporary building <br />and no trailer, tents, shack or garage on any Lot within the Subdivision shall be <br />used as either a temporary or permanent place of business, other than as a <br />temporary construction office or temporary equipment storage during the <br />construction period described in Section 2.a. of this Declaration. <br />10 <br />201802007 <br />i. Commercial broadcast towers or free standing cell towers, but <br />excluding communications systems required for hospital use or <br />operations; <br />ii. Sexually oriented businesses; <br />iii. Any use that involves a noxious odor, excessive emission of <br />smoke, steam, or vapor, an excessive noise level, or vibration; <br />iv. Agricultural uses, including animal husbandry, commercial <br />breeding businesses or feed lots; <br />v. Auto wrecking and salvage; junk yards; storage or wrecking <br />yards; or recycling operations; <br />vi. Industrial or manufacturing uses; <br />vii. Other than the operator of the Hospital on the Hospital Lot, <br />who is not prohibited from such uses, any inpatient or <br />outpatient healthcare services which are in direct competition <br />with the healthcare services provided by the Hospital; an <br />ambulatory surgical center; a dialysis center; rehabilitation <br />services, including, but not limited to, physical, occupational <br />and speech therapy; diagnostic imaging services; clinical <br />laboratory and pathology services; and home health services, <br />including hospice and durable medical equipment. Such <br />Prohibited Uses may be waived by the mutual written <br />agreement of the Declarant and the owner of the Hospital Lot. <br />viii. Retail tobacco, tattoo, liquor, pay -day loan/check- cashing, or <br />gaming /lottery /gambling establishments; or <br />vi. Any use that is contrary to law or violates any part of this <br />Declaration. <br />b. Exclusive Uses. No Nebraska - licensed hospital or hospital -owned <br />facility shall be constructed and /or operated on any lot other than the Hospital <br />Lot. <br />5. Prairie Commons Association. <br />a. Association; Membership. Prior to the expiration of the Period of <br />Declarant Control, Declarant shall establish a business owners association for the <br />Subdivision (the "Association ") to assist in governing the Subdivision and enforcing <br />this Declaration. The Association may be established as a Nebraska nonprofit <br />corporation or an unincorporated association. The form of bylaws and other <br />organizational documents for the Association shall be reviewed and approved by a <br />majority of all non - Declarant Lot Owners in the Subdivision at the time of the <br />formation of the Association. Each Lot Owner shall be a member of the <br />Association. Membership in the Association shall be appurtenant to and may not <br />
