Gregersen ( "New Borrower"). <br />WHEREAS, Harry E. Gregersen, Deceased (Original Borrower) is the maker and obligor of a certain <br />Note dated November 3, 2016, in the original principal amount of $92,000.00 (the "Note "), the terms and <br />conditions of which are incorporated herein by this reference; <br />WHEREAS, as security for the repayment of the Note, Original Borrower executed a mortgage, deed of <br />trust or other security instrument of even date with the Note which is filed of record as follows: November 10, <br />2016, in Instrument #201607548, Assignment to West Gate Bank which is filed of record as follows: November <br />10, 2016, in Instrument #201607549 (the "Mortgage "), the terms and conditions of which are incorporated herein <br />by this reference; <br />WHEREAS, the Mortgage constitutes a first lien in and to the real estate identified as (the "Property "); <br />Lot Forty - Four (44), Wolfe's Subdivision to the City of Grand Island, Hall County, Nebraska <br />WHEREAS, Bank is the current holder of the Note and is servicing the Note and Mortgage; <br />WHEREAS, a Quit Claim Deed was filed, conveyed and released to Bruce A. Gregersen. This deed was <br />filed January 26, 2017, in Instrument #201700583. <br />WHEREAS, Original Borrower is now deceased and New Borrower is occupying the Property and has read <br />the Note and Deed of Trust and understands all of the obligations set forth therein: <br />WHEREAS, New Borrower desires to assume all obligations set forth in the Note and Deed of Trust which <br />are current and have been fully complied with as of the date of this Agreement; <br />WHEREAS, Bank is willing to consent to said assumption provided that the estate of the Original <br />Borrower retains all of the obligations and liability under the Note and Deed of Trust; <br />
