PURCHASE AGREEMENT FOR VACANT LAND <br />KNOW ALL MEN BY THESE PRESENTS: <br />20170730S <br />The undersigned Seller does hereby sell to the undersigned Buyers the following - <br />described real estate for the price and upon the terms and conditions set forth herein, and the <br />undersigned Buyers do hereby accept said terms and conditions, agree to pay the purchase price, <br />and to perform the obligations of the Buyers hereunder. <br />1. The Seller is THELEN GRAIN COMPANY, a Nebraska corporation. <br />2. The Buyers are AUBREY BOUCHER and LISA BOUCHER, husband and wife. <br />3. The address of the real estate is XXX East Street, Wood River, Nebraska 68883 <br />and the legal description of the real estate is: <br />A 160 ft. x 43 ft. tract of land located in part of the Northwest Quarter (NW114) of <br />Section Nineteen (19), Township Ten (10) North, Range Eleven (11) West of the 6 <br />P.M., Hall County, Nebraska. <br />4. The purchase of the 160 x 43 tract of land adjoining the north side of Lot One (1) <br />of the Stacy Jo Subdivision is contingent upon the approval of a replat of the two tracts of land <br />into one lot by the Regional Planning commission of Hall County and The City of Wood River, <br />Nebraska. <br />5. The purchase price is Three Thousand Four Hundred Forty and NO /100 Dollars <br />($3,440.00). <br />5. The purchase price shall be paid to the Seller by the Buyers as follows: <br />The purchase price in the amount of Three Thousand Four Hundred Forty and NO /100 <br />Dollars ($3,440.00) shall be paid in cash by cashier's check or certified funds at closing <br />as hereinafter provided. <br />6. The Buyers shall be entitled to possession of the subject property upon the closing <br />of this transaction, and the closing shall be on or before December 1, 2017, unless otherwise <br />mutually agreed by the Seller and the Buyers, which is herein called the closing date. <br />7. As soon as reasonably possible after the execution of this agreement, the Seller <br />shall furnish the Buyers with an Owner's Title Insurance Commitment showing marketable title <br />to the real property to be vested in the Seller subject only to easements, restrictions and <br />conditions of record. Within a reasonable time after the Buyers' receipt of said title insurance <br />commitment, the Buyers shall furnish the Seller with a written opinion from the Buyers' attorney <br />containing any objections to the Seller's title which the Buyers claim to exist. If the Buyers find <br />any meritorious defects in the Seller's title, then the Seller shall have the option of canceling this <br />Agreement or of correcting and curing the defect in title. If the Seller elect to cure and correct <br />the defect in title, the Seller shall have a reasonable time within which to do so. <br />The parties hereto agree that the cost of the Owner's Title Insurance Policy in the amount <br />of the purchase price shall be paid equally by the Seller and the Buyers. <br />Sellers / <br />Buyers / ,e / dt b <br />
