3 <br />201705553 <br />1. Commercial Development Zone. Lots One (1), Two (2) and Three (3) along <br />with Outlots Two (2) and Three (3) of this subdivision are within a designated Commercial <br />Development Zone and shall be regulated in accordance with Chapter 36 of the Grand Island City <br />Code. A Development Plan (Exhibit A), Landscaping Plan (Exhibit B), Building Elevation Plan <br />(Exhibit C), Sidewalks and Trails Plan (Exhibit D), and Easement Plan (Exhibit E) are all attached <br />hereto and incorporated herein by reference, and are hereby approved for such subdivision. Any <br />amendments to said plans shall be approved by the City of Grand Island in accordance with the <br />Grand Island City Code. Each of the current official plans identified herein shall be on file with the <br />City's Planning Department. <br />2. Design and Construction within the Commercial Development Zone. No <br />building shall be constructed within the Commercial Development Zone except within the Building <br />Development Areas as defined on the Development Plan (Exhibit A). The buildings to be <br />constructed (typical elevations shown on. Exhibit C) shall be designed so that the exterior of such <br />building shall be architecturally and aesthetically compatible in material and color. The design and <br />construction shall be in conformity with sound architectural and engineering standards. No portion of <br />any building constructed (including architectural features) shall exceed a height of one hundred and <br />twenty (120) feet above the center of the intersection of James Road and Husker Highway. <br />3. Paving. The Subdivider agrees to pave Ewoldt Street, Prairieview Street and <br />Rae Road in accordance with plans and specifications approved by the City's Director of Public <br />Works, and subject to the City's inspection which shall include the dedication of adjacent land south <br />of the subdivision for Rae Road. If the Subdivider fails to pave Ewoldt Road, James Road and Rae <br />Road, the City may create a paving district to perform such work. The Subdivider agrees to waive the <br />
