ALLEN FAMILY LIMITED PARTNERSHIP, a <br />Nebraska limited partnership (hereinafter referred to as "Declarant "). <br />WITNESSETH: <br />Declarant was and is the record owner of Lot 1, Meadowlark West Third Subdivision, in <br />the City of Grand Island, Hall County, Nebraska (herein "Lot 1"). Declarant desires to establish <br />a private non - exclusive easement for access over the southerly five feet one inch (5' 1 ") of Lot 1 <br />(herein the "Easement "), and more specifically located and described and pictorially depicted on <br />Exhibit "A" attached hereto (herein the "Easement ") for the purpose of providing nonexclusive <br />access for the repair and maintenance of the building which is located immediately adjacent to <br />the northerly line of Lot 2, Meadowlark West Third Subdivision, in the City of Grand Island, <br />Hall County, Nebraska (herein "Lot 2 "). <br />The Declarant hereby establishes the Easement as follows: <br />1. Easement. The Declarant grants a nonexclusive easement for access over the <br />southerly five feet one inch (5' 1 ") of that portion of Lot 1 which is parallel to and adjoins the <br />northerly building wall of the existing Albertsons Supermarket, for the purpose of providing <br />access for the repair and maintenance of such northerly building wall which is parallel to and <br />adjoins the northerly building wall of the existing Albertsons Supermarket located on Lot 2. <br />The Easement shall automatically terminate at such time as the building located on Lot 2 is <br />permanently removed, excluding any periods for repair or reconstruction. <br />2. Use. Declarant shall have the unrestricted use of the area within the Easement <br />subject to the reasonable exercise of the rights granted in this Declaration. In use of the <br />Easement, the owner of Lot 2 and its tenants, subtenants, employees, agents and contractors <br />(collectively "Grantees ") shall not unreasonably interfere with or block the usage of the <br />Easement area by Declarant and its tenants, subtenants, employees, agents and contractors.
