89-- 100296 <br />lot upon which said structure is located within two construction <br />seasons after completion of said sewer main. <br />r4. Dra�inaM. The Subdividers agree to grade all lots in the <br />subdivision in conjunction with the structures thereon in such a <br />manner as to conduct storm water flow to the public right -of -way, <br />or other drainage facility as approved by the Director of Public <br />Works. <br />5. Sidewalks. The Subdividers agree to construct sidewalks <br />within one year adjacent to Lot 1 in accordance with the <br />requirements of the Director of Public Works with a proper permit, <br />and adjacent to Lot 2 when it is built upon, and adjacent to Lot <br />3 within six months upon direction by the Grand Island City <br />Counei l . <br />6. Flood Plain. Since the subdivision is partially in.the <br />flood plain, any new residential structures or additions. to <br />existing structures constructed in -;that area shall have the lowest. <br />floor elevation to a minimum of one foot above the. elevation of the <br />2,00 -year flood, as determined by the build permit received by <br />the Subdividers or successors from the Bu'L ing Department under <br />the provisions of Section 2- 1506.06, R.R.S. 1943:: No basement <br />shall be constructed in connection'with any structure in the fled: <br />plain unless such basement is flo dproofed and certified as such <br />by a qualified registered eh9ineer or architect. <br />Tp Warranty. The undersigned owners, as Subdividers.... <br />warrant that they are the owners in fee simple of the land <br />described and proposed to be known as HIDDEN LAKES SUBDIVISION <br />NUMER SEVEN, and that an abstract of title will be submitted for <br />examination, if necessary, upon request 'of the City of Grand <br />island. <br />8. This agreement shall run with the land and shall be <br />binding upon and inure to 'the benefit of the parties hereto, its <br />successors and assigns.
