200105824 <br />yard run -off. Grantee shall also have rights of ingress and egress over said property for the <br />maintenance of said cells and the establishment of new cells if needed. <br />3. Consideration. In consideration for the granting of said easement, Grantee hereby <br />agrees to pay Grantor the sum of Fifty and 00 /100 Dollars ($50.00) per acre, each year, for a total <br />of One Hundred and Twenty -Five Dollars ($125.00) per year. Said payments shall be due and <br />payable on the I' day of May of each year. <br />4. Grantor's Retention of Rights. Such easement hereby established is specifically subject <br />to the reservation by the Grantor that said land may be used by Grantor, their heirs, successors <br />and assigns, as to its entirety, and further subject to the express understanding that the Grantor, <br />their heirs, successors ad assigns, shall in no way be bound to construct, or maintain the drainage <br />cells and shall in no way assume any liability or responsibility to Grantee, its successors and <br />assigns, or any other person or business for damage or injury to said drainage cells. <br />5. Obligations of Grantee. The continued right to this easement is expressly conditioned <br />upon the Grantee, its successors and assigns, being solely responsible for all costs and expense <br />necessary for the installation and maintenance of such drainage cells. Grantee shall also assure <br />that the use of such drainage cells will not unreasonably interfere with the normal usage of <br />Grantor's tract. <br />6. Option to Extend Easement. At the end of the five year term, assuming that the <br />Grantor still owns said real estate, the Grantee shall have the option to extend the easement for an <br />additional five (5) year period under the same terms and conditions contained in this Easement <br />Agreement by executing a new easement agreement. <br />7. Indemnification. Grantee, its successors and assigns, shall indemnify and hold Grantor, <br />their heirs, successors and assigns, harmless from any liability in respect to the injury of any <br />person while using such easement with the permission or at the direction of the Grantee, its <br />successors or assigns. <br />8. Binding Effect. This Easement Agreement shall be binding upon, and shall inure to the <br />benefit of the parties hereto, their heirs, legal representatives, successors and assigns. <br />IN WITNESS WHEREOF, the undersigned have executed this Easement Agreement uon <br />the date first noted above. <br />Robert W.
