<br />This instrument, made this %Zhh day of July, 2000 between Eric H. Lindquist, a member of the
<br />Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a power of sale
<br />contained in that certain Deed of Trust recorded on June 30, 1997 as Instrument No. 97- 105157 in the
<br />Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska, and the Secretary of the
<br />Department of Housing and Urban Development, hereinafter called "Grantee ":
<br />WHEREAS, on February 14, 2000 Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Francisco Miguel and Angelina Domingo DeMiguel,
<br />husband and wife, Trustors, under that certain Deed of Trust recorded as Instrument No. 97- 105157 of the
<br />Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska, covering that certain
<br />premises described as:
<br />A certain part of the Northwest Quarter (NW1 /4) of Section Twenty -Six (26), in
<br />Township Eleven (11) North, Range Ten (10) West of the 6th P.M., Hall County,
<br />Nebraska, more particularly described as follows, to wit: From a point where the north
<br />right -of -way line of the Union Pacific Railroad Company intersects the east line of the
<br />Northwest Quarter (NWl /4) of Section Twenty -six (26), in Township Eleven (11),
<br />North, Range Ten (10), West of the 6th P.M., running thence southwesterly along and
<br />upon the north right -of -way line of the Union Pacific Railroad Company, for a distance
<br />of 450.0 feet to the actual point of beginning, running thence north parallel to the east
<br />line of said Northwest Quarter (NW1 /4) of said Section Twenty -six (26), 225.0 feet,
<br />running thence southwesterly parallel to the north right -of -way line of the Union Pacific
<br />Railroad Company, for a distance of 225.0 feet, running thence south parallel to the east
<br />line of the Northwest Quarter (NW1 /4) of said Section Twenty -six (26), 225.0 feet to a
<br />point on the North right -of -way line of the Union Pacific Railroad Company, running
<br />thence northeasterly along and upon the north right -of -way line of the Union Pacific
<br />Railroad Company, a distance of 225.0 feet to the point of beginning;
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting forth the
<br />nature of such breach and of his election to sell or cause to be sold such property to satisfy the obligation.
<br />Said Notice of Default was filed for record in the Office of the Register of Deeds of Hall County, Nebraska,
<br />on February 16, 2000 as Instrument No. 2000 -01283 in the Miscellaneous Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice pursuant to
<br />said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on March 28, 2000, Grantor caused to be published in The Grand
<br />Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a Notice of
<br />Trustee's Sale setting forth a description of the property to be sold and stating that the described property
<br />would be sold at public auction to the highest bidder for cash or certified or cashier's check, at the lower
<br />level lobby of the Hall County Courthouse, 1St & Locust Street, Grand Island, Nebraska, at 10:00 a.m. on
<br />May 10, 2000. Publication of such notice was made for five consecutive weeks on March 28, 2000, April 4,
<br />2000, April 11, 2000, April 18, 2000, and April 25, 2000, the last publication being at least ten (10) days but
<br />not more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties entitled to
<br />notice pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
