CT <br />TERRY GENE CALLAHAN, <br />Respondent. )` <br />s <br />Now on this 1st day of February, 1982, -this matter came <br />on for trial in the District Court of Colfax County, Nebraska, <br />before the Honorable John C. Whitehead, District Judge, upon <br />the petition filed herein. <br />Petitioner appeared personally and by counsel, James G. <br />Egley. Respondent appeared personally and by counsel, Cleo <br />Robak. <br />The matter proceeded to trial, evidence was adduced and <br />the parties rested. The Court, upon consideration of the <br />record and evidence and being fully advised in the premises, <br />f ir;ds as f011OWS : <br />1. More than sixty (60) days have passed since service <br />of process was perfected; the Court has jurisdiction over <br />the subject matter of the parties to this action. <br />2. The parties have made every effort to effect a <br />reconciliation without success, and the marriage of the <br />petitioner and the respondent is irretrievably broken. The <br />marriage of the parties should be an the same hereby is <br />dissolved provided, however, such dissolution shall not <br />become final, except for purposes of appeal, for six (6) <br />months from this date. <br />3. The petitioner is a fit and proper person to have <br />the care, custody and control of the minor children of the <br />parties. Custody of the minor children of the parties, Troy <br />A. Callahan, born June,7,,1973,and Wendy L. Callahan, born <br />May 15, 1975, should be and hereby is awarded to the petitioner, <br />subject to the reasonable rights of visitation of the respondent. <br />Such reasonable rights of visitation shall include two weeks <br />every summer.
