2� 17�2� 19 <br /> _ � <br /> LES S BENEFICIARY SHALL SURVIVE THE �ANCELLATI�N �F THE SE�UREI] <br /> �BLIGATI�NS AND THE RELEASE, RE��NVEYANCE �R PARTIA.L REC4NVEYANCE �F <br /> THIS I]EED�F TRUST. <br /> �e� Trustor�hail adv�se Ben�ficiary in writ�ng within ten�1 D� days of Trus�or's d�scovery of any � <br /> occurrence �r condition on the Trust Property or on any real proper�y adj aining ar in�he vicinity of the <br /> Trusti Property that does or cou�d cause a�� or any part of the Trust Proper�y to be contami.nated w�th any <br /> Hazardous Materia�s or otherwise be in �iolation of any Hazardous Materials Laws, or cause the Trust <br /> Froperty to be subj ect to any restrictrons on the ownership, accupan�y,transferabi�i�y or use thereof under <br /> any Hazardous Materials Laws. <br /> 3.1.� Protecti�n of Security. Trustor shal�, at Trustar's sole expense: (a}prflte�t, preserve and <br /> defend �he Trust Property and Trustor's t�tle and �ight ti� possession of the Trus� Prop�rty against a�� <br /> adverse claims; �b�if Trustar's �n��rest in th� Trust Property is a leasehold �nterest or estate, pay and <br /> perform in a t�mely manner a11 obligations to be paid andlar performed by the lessee or tenant under the <br /> Iease or other agr�ement creating such leasehold interest ar �s�ate; and �c�proteCt, preserve and defend <br /> � <br /> the security of this De�d of Trust and the rights and powers of Benef��iary and Trustee under this Deed of � <br /> Trust agains� all adverse cla�ms. Trustor sha�l giv� Benef ciary and Trustee prompt no�ice in writing of <br /> the assertian of any claim, the f��ing of any action or prac�eding, or the occurrence of any materia� , <br /> damage, candemnation offer or ather action re�ating ta or affect�ng the Trust Property and, �f Trus�or's <br /> interest in the Trust Praperty is a �easehQld interest ar estate, af any no�ice of default or demand far <br /> performance under the lease or other agreement pursuant to wh�ch such l�asehald interest or es�ate vvas <br /> creat�d or�xists. <br /> 3.11 Acceptance af Trust; Pa�vers and Dut��s af Truste�. Trustee accepts this trust when th�s <br /> I]eed of Trust �s executed. Fram time to �ime, upon written request of Benef�ciary and, to the �xtent <br /> required by applicahle law presentation of�his D�ed af Trust for endorsement, and with�ut affecting the <br /> persor�al liabi�ity of any person for payment of any indebtedness or performance of any of the Secured <br /> �bliga�ions, Beneficiary, or Trustee at Beneficiary's directian, may, without obligatian to do s� or <br /> liabi�i�y th�refor and without notice: �a�reconvey a�� or any part of the Trust Property from the �ien of <br /> this De�d of Trust; �b�consent to the mal�ng af any map or pla� of the Trus�Property; and�c}j oin in any <br /> gran� of easement or declaration of covenants and restrictions with respect to the Trust Praperty, or any <br /> extens�on agreement or any agreement subordinating the lien or�harge af this Deed of Trus�. Trustee or <br /> Beneficiary may from time to t�me app�y �o any court of competent jurisdiction far aid and dir�ctivn in <br /> tihe execution �f the trusts and th� enforcement of its rights and remedies available under this Deed of <br /> Trust, and may �btain orders or decrees d}rect�ng, conf'�rming ar apprav�ng acts ir� �he execut�on of said <br /> trusts and th� enfarcement of said rights and remedies. Trus�ee has no ob�iga�ion�o notify any party af <br /> any pending sale or any ac�ion or proceeding ��ncluding, but nat limited t�, actions i.n whi�h Trus�ar, <br /> Benef�ciary or Trustee shall be a party} unl�ss held or cammenced and ma�ntained by Trustee under this <br /> I]eed of Trust. Trust�e sha�l no�be obligated to p�rf�rm any a�t required of it under this Deed of Trust <br /> un�ess the performance of the act is requested in writing and Trustee is reasanably indemnifi�d a�ainst all <br /> ��55�5, C�5t5, liabilities and�xpenses in cannec�ion therewith. <br /> 3.1� �ompensat�on; Exculpation• Indemnificataon. ' <br /> �a} Trust�r shall pay a11 Trustee's fees and reimburse Trustee for al� expenses in the <br /> administration of�his trust, including reasonable attorneys' fees. Trustor shall pay Beneficiary reasonab�e <br /> compensation for services rendered concerning this De�d �f Trus�, lI]C�I�C�lI1� wi�h�ut l�mitation, the <br /> pr�viding of any statement of amounts owing under any Secured �bligation. Ben�ficiary shall not <br /> directly or indirectiy be liable ta Trustor or any other persan as a consequence of: �i]the exercise of any <br /> rights, remedies �r powers granted to Benefic�ary in th�.s Deed of Trust; �ii}the failure or refusal of <br /> Benefi��ary to perf�rm�r d�scharge any obl�gati�n ar liability of Trus�or under this Deed of Trust or other <br /> agreement reiat�d to the Trust Proper�y; or�iii}any loss sustained by Trustor or any third party as a resu�t ; <br /> -5- <br />
