The maximum <br /> amount secure� by this Deed flf Trust shall nat in any way imply that Ben�ficiary shall b� obliga��d to <br /> advance any amoun�at any time. Advances or disbursements made by Beneficiary��protect the security, <br /> under the terms h�re�f, shall not be deemed ta be optional advances. <br /> ARTI�LE III. RIGHT S AND DUTIE S �F THE PA►RTIE S <br /> 3.1 Title. Trustar warrants that Trustor lawfully possesses and holds fee simple�itl�to the Trust <br /> Pr�perty without I�mitat�on on the right to encumber, as herein pro�ided, and that this I]eed of Trust is a <br /> valid first pr�ority lien on the Trust Pr�per�y and a�l of Trustar's intierest there�n. <br /> 3.2 Taxes and Assessments. Sul�j ect �� the right, if any, of Trustor �� con�est payment of the <br /> follawing pursuant �a any other agr�ement between Trustor and Beneficxary, Trustor shai� pay prior to <br /> delinquency all taxes, assessments, �evies and charges imposed: �a�by any public or quasi-pub�ic <br /> author�ty or uti�ity company which are or which may become a lien upon or cause a loss in va�ue of the <br /> Trust Property or any interest there�n; or �b}by any public authori�y upon Benefic�ary by reason of its <br /> interest xn any Secured �bligation or iz� the Trust Praperty, or by reason of any payment made �o <br /> Beneficiary pursuant to any Secured�bligation; pr�vided however, that Trustor shall hav�no ob�igation <br /> �o pay any income taxes of Beneficiary. Within ten �1�) days of Benefic�ary's written request, Trustor <br /> shall furnish to Beneficiary satisfactory e�idenc� of the payment of alI �f the foregoing. Ben�ficiary is <br /> hereby authorized to request and receive fram the responsib�e governmental and nan-ga�ernrnental <br /> personnel written statements with respect to�he accrual and payment of any of the faregoing. <br /> 3.3 Performance of Secured �b�i ations. Trus�ar sha�l prompt�y pay and perfarm each Secured <br /> ��ligatian wh�n due. <br />� 3.4 Liens Encumbrances and Char es. W�thin �en ���� days of Beneficiary's wri�ten request, <br /> Trustar shall discharge, or to the ext�nt permitted hy 1aw, bond �ver, any lien on the Trust Property not <br /> appr�ved by Benefi�iary in writ�ng. Except as oth�rwise pro�ided in any Secured �bl�gatian �r ather <br /> agreement with Beneficiary, Trustor shall pay when due a11 abligatinns s�cured by or reducibie t� l�ens <br /> and encumbrances which shall now or hereafter encumber the Trus� Property, whether senior or <br /> subordinate hereto,inc�uding without limitati�n, any mechanics'or construction l�ens. <br /> 3.5 Insurance. Trustor shall insure �he Trust Property against loss or damage by fire and such <br /> �ther risks as Benef�ciary shall fram time to time require. Trus�ar shal� �arry public liabi�ity insurance, <br /> flood insurance as required by applicable law and such other insuranc� as Beneficiary may reasonab�y <br /> requ�re, including wi�h�ut Iimitation, terr�rism, business �nterrup�iar� insuran�e or �oss af rental valu� <br /> insuranc�. Trustor shal� maintain all required insurance at Trustor's expense, under policies issu�d by <br /> campanies and in form and substance sa�isfac�ory �o Beneficiary. Neither Beneficiary nor Trustee, by <br /> reason of accepting, rej ecting, approving or abtairllng �nsurance, shall in�ur any Iiab�lity for: (a)the <br /> -3- <br />
