201702574 <br />shall be constructed at the Owner's expense. The materials and construction of the retaining wall <br />must be approved by the Architectural Control Committee. <br />21. PETS AND LIVESTOCK. No animals of any kind, including but not limited to <br />livestock, chickens, or fowl, shall be raised, bred, housed, quartered, or kept on any Lot, except <br />that household pets consisting of no more than two (2) dogs and no more than two (2) cats, along <br />with other usual ordinary household pets confined to cages or aquariums within the dvvelling, <br />shall be permitted provided they are not kept, bred, housed, or maintained for any commercial <br />purpose. Any such domestic animals kept as pets must be restrained, quiet, orderly, and <br />confined and kept off the premises of other Lot Owners so as not to disturb the peaceful <br />enjoyment of other lot owners. All animal waste generated by pets must be promptly and <br />appropriately disposed of so as not to be offensive to the Owner of any other lot. Complaints of <br />unnecessary barking or destruction caused by pets will be referred to the appropriate authorities <br />of the City of Grand Island. Any pet causing or creating a nuisance or unreasonable disturbance <br />or noise shall be permanently removed from a Lot upon three (3) days written notice and a <br />hearing conducted by the Association. Service animals, including seeing eye dogs hearing dogs, <br />shall be permitted for those persons holding certificates of necessity. Each Owner of a Lot <br />agrees, to the extent permitted under Nebraska law, to indemnify, save, and hold harmless the <br />Association from any claim arising out of the action of the pets of such Owner or of any <br />occupant of such Lot. <br />22. HUNTING. Hunting and the discharge of firearms is strictly prohibited within <br />any of the Northview Subdivisions. <br />23. VEHICLES. No campers, trailers, motor or mobile homes, boats, recreational <br />vehicles, trucks larger than a 1 ton pickup truck, farm machinery or implements shall be stored <br />upon any Lot outside, upon the driveway of any Lot, or on the street or road in front of any Lot <br />for a period greater than five consecutive (5) nights; provided, however, the Association or <br />Architectural Control Committee may give written permission to allow parking of vehicles <br />outside, as well as require landscaping to maintain the aesthetic appearance of the area. <br />24. MAINTENANCE OF LOTS AND IMPROVEMENTS. Each Owner of a Lot <br />shall keep or cause to keep his or her Lot in a neat appearance and kept free of unsightly <br />structures or personal property. Rubbish, refuse, garbage, and other solid, semi-solid, and liquid <br />waste shall be kept within sealed containers, shall not be allowed to accumulate on any lot, and <br />shall be disposed of in a sanitary manner No Lot shall be used or maintained as a dumping <br />ground for any materials. All containers shall be kept in a neat, clean, and sanitary condition and <br />shall be stored inside. No trash, litter or junk shall be permitted to remain exposed upon any Lot <br />or visible from adjacent streets or other Lots. Burning of trash on a Lot shall be prohibited. No <br />lumber or other building materials shall be stored or permitted to remain on any Lot unless <br />screened from view from other Lots and except for reasonable storage during construction. <br />25. DAMAGE OR DESTRUCTION OF IMPROVEMENTS. If any Lot or structure <br />constructed on a Lot is damaged, either in whole or in part, by fire or other casualty, said <br />structure shall be rebuilt in a timely manner, not to exceed six (6) months from the date of <br />damage. <br />8 <br />
