<br /> 5ubsequent Taxes. If any tax ta which this sec�ion applies is �nacted subsequent �o the date af this Deed of
<br /> Trust, this e�ent shall ha�e the same effe�t as an E�ent of Default, and Lender may exercise any or all o� its
<br /> a�ailahle r�medies for ar� E�ent o� De�au�t as pra�ided belov� unless Trustor either �1} pays the tax before it
<br /> becomes delinquent, or �2} contests �he �ax as pro�ided abo�e in the Taxes and L�ens sectian and deposits with
<br /> Lender cash or a su�fiicien�corporate sur�ty hond or other security sa�isfac�ory to Lender.
<br /> SECUR�TY AGREEf111ENT; F�N►�NCEN� STATEMENTS. The follawing pro�isions rela�ing to this Deed of Trus� as a
<br /> security agreement are a part❑fi this Deed of Trust:
<br /> S��urity Agreement. This instrumen� shall �onstitu�te a 5�curity Agreement to the ex�ent any of the Praper�y
<br /> constitutes fix�ures, and L�nder shall ha�e all of the rights af a secured party under the Uniform Commercial Code

<br /> Secur�ty in�erest. lJpon request by Lender, Trustvr shall take wha�e�er actian is request�d �y Lender t❑ per�ect
<br /> and continue Lender's security in�erest in the Rents �nd Persanal Praper�y. !n addi�ion t� recording this Deed of
<br /> Trust in the reaf praperty records, Lender may, at �ny time and withaut �urther au�horizativn f�om Trus�or, file
<br /> executed coun�erparts, copies vr reproductions of this Deed of Trust as a financ�ng sta�emen�. Trustor shall
<br /> reimburse Lender�ar afl expenses incurred in perfecting ar continuing this security inter�st. Upon defauft, Trustor
<br /> shall not r�mo�e, se�er or detach the Personal Proper�y �ram the Pr�perty. Upon de�au�t, Trus�or shall assemhle
<br /> any Personal P�aper�y not affixed to the Property in a manner and a� a pla�e reasanab�y con�enien��o Trustor and
<br /> Lender and mak� i� a�ailable t❑ Lender within three �3} days af�er receip� o�f written demand from Lender to the
<br /> ex�ent permitted hy applicable faw.
<br /> Addresses. The mai�ing addresses af Trus�or {debtor} and L�nder tsecured party� from which infivrmatian
<br /> conce�ning the secur�ty interest granfied t�y this ❑eec9 of Trust may be ❑btained 4each as required by the Uni�orm
<br /> ��mmercial Code� are as stated on th� #irs�page of�his ❑eed of Trust.
<br /> FIJRTHER ASSURANCES: ATTQRNEY-IN-FACT. The following pro�isions relating to further assuran��s and
<br /> a�tarney-in-faGt are a part of this Deed of Trust:
<br /> Further Assurances. At any time, and �rom time fio �ime, upon request of Lender, Trustar will mak�, execu�e and
<br /> deli�er, ar will �ause to be made, exeGu�ed or defi�ered, t� Lender or to Lende�'s d�signee, and when requested by
<br /> Lender, cause to �e fil�d, r�c�rded, refiled, or rereco�ded, as �he case may be, at such times and in such oftic�s
<br /> and plac�s as Lender ma� d��m appropriate, any and all such mortgages, d�eds a�trust, security dee�s, se�urity
<br /> agreements, �inancing statements, continuation statemen�s, instruments of further assu�an�e, cer�ificates, and
<br /> v�her dacuments as may, in the sale opinion o� L�nder, be necessary or desirable in �rder to efi�ectuate, complete,
<br /> perfec�, continue, or preser�e �1 y Trustor's ob€€g�tians under the No�e, this Deed of Trust, and the Related
<br /> Documents, and 4�� the liens and security interest� cr�at�d hy this Deed of Trus'� as first and prior (iens on �he
<br /> Prap�rty, whether now owned �r hsreaf�er acquired by Trustor. Un�ess prohih�ted by faw or Lender agrees to the
<br /> contrary in wri�ing, Trustar shall re�m#�urse Lender �or all costs and expenses incurred in connec�ivn with the
<br /> ma�ters re��rred to in�his paragraph.
<br /> Attorney-in-Facfi. I#Trustar�ails to do any of�he th�ngs referred to in the pre�eding paragraph, Lender may do sa
<br /> for and in �he name ❑�Trustor and a�Trus�or's exp�nse. For such purposes, Trustor hereby irre�vcai��y appoin�s
<br /> . Lender as T�ustvr's attorney-in-�act for the purpase of making, executing, deli�ering, filing, rscording, and da�ng all

<br /> FULL PERF�RMANCE. If Trustor pays all the Indebtedness, including without iimitativn all fu�ure ad�ances, wh�n due,
<br /> and otherwise pe�fiarms all the obiigations imposed upon Trustor under this Deed o� Trust, Lender shall execute and
<br /> deli�er �v Trustee a request for fuE� recon�eyance and shall execute and d�li�er to Trustor suitable statem�nts o�
<br /> ��rmina�ion of any fiinancing �tatement on �ile e�idencing Lender's security in�erest in the Rents and the P�rsona!
<br /> Prop�rty. Any recon�eyance#ee required by faw sha�l be pa�d by Trus�kor, i#permit�ed by appli�able �aw.
<br /> EVEIVTS C]F DEFAULT. Each o#the fvllvwing, a� Lender's option, shall �onstitute an E�ent of Default under this Deed
<br /> of Trust:
<br /> Paymen�Defautt. Trustar fails t❑ make any payment�rvhen due under fihe fndeb�edness.
<br /> �ther Defaults. Trustor �ails to comply with vr to perform any ❑the� term, obliga�ion, co�enant ar c�ndi�ion
<br /> �ontained in this Deed of Trust or in any of �he R�lated Documents or to comp�y wi�h or �o perform any term,
<br /> obl�gation, co�enant or condition contained in any other agreement between Lende�and Trustor.
<br /> Compfian�e Defaui�. Failure to comply with any fl�her �erm, obligation, co�enant or conditian �ontained in this
<br /> Deed of Trust, the No�e or in any n�the Re�ated ❑acuments.
<br /> Defaui�on �ther Payments. Failure of Trustor within-�he time required by this Deed of Trust ta make any payment
<br /> for taxes or insurance, or�ny ather payment necessar�t� pre�ent filing v�or to effect discharge❑f any 1ien.
<br /> D�fauit in Favor o�Th'rrd Parties. 5hould Gran�or default under any loan, extensian ❑f �redi�, security ag�eemen�,
<br /> pur�hase or sales agreement, or any o�her agreement, in �a�or of any other �reditor or person that may materially
<br /> af�fect any af Grantar's p�aperty ❑r Grantor's ability to repay the Indebt�dness or Gran�or's ability to per�arm
<br /> Grantor's o#�liga�ions under this ❑eed of Trust or any af the Related Documents.
