Hazardaus Substances. As used in th�s S�ctivn ��: �a} "Hazardous Subs�ances" are those substances <br /> defined as�axic or hazardaus substances, pollutants, or vWastes by En�ironmental Law and the fo�low�ng substances: <br /> gasol.ine, kerosen�, other flammable or tax�c petroleum products, tioxic pesticides and h�rbicides, �olatile sol�ents, <br /> ma�er�als cantiaining asbestos �r formaldehyd�, a.nd rad�oacti��materials; �b� "En��ronmenta� Law" means federal <br /> laws and�aws of the jurisdiction where the Property is located tha�relate to hea�th, safety ar en�iranmental prvtection; <br /> �c� "Environmental Cleanup" includes any response action, remedial a�tion, �r remo�al action, as defined in <br /> En�ironmen�al Law; and �d} an "En�ironmental �ondition" means a condition that can caus�, contribute to, ar <br /> otherw�se trigger an En��ranmental �leanup. <br /> BorravWer shall not cause or permit the presence,use, disposal, storage, or release of any Hazardous Substanc�s, <br /> or threaten to re�ease any Hazardous Substances, on or in the Property. Borrower sha11 no�do, nor ailaw anyone else <br /> �a do, anything affecting the Praperty �a} that is in violatian of any En��ranmental Law, �b} which creates an <br /> En�iranmental Condition, or �c} which, due to the presence, use, or release of a Hazardous Substance, creates a <br /> condi�ion that adversely affec�s the �a�ue of�he Praperty. The preceding two sen�ences shall not app�y to the <br /> presence, use, or starage an the Property of small quantit�es of Hazardous Substanc�s tha�are genera�l�recognized <br /> to be appropria�e ta normal resident�al uses and to maintenance of the Pr�perty �including, but n�t �imited to, <br /> hazardous substances in consumer products}. <br /> Borrower shall promptly gi�e Lender written notice of�a} any in�e�t�gation, c�aim, demand, lawsuit or nther <br /> ac�ian by any go�ernmental�r regula�ary agency or pri�ate party invol�ing the Praperty and any Hazardaus Substance <br /> or Enviranmental Law of which Borrower has actual knowledge, �b}any En�.iranmental Condition, including bu�not <br /> limited to, any spil�ing, leaking, discharge, release or threa� �f release of any Hazardous Substance, and �c) any <br /> condition �aused by �he presence, use or release of a Hazardous Substance which ad�erse�y afFects tihe�a1ue af the <br /> Property. If Borrawer learns, or is notified by any go�ernrnental o.r regulatory authority, or any pri�ate party, that <br /> any rem.a�al or nther remediation of any Haza.rdaus Substance affecting the Property is necessary, Borro�er shall <br /> promptly take a11 necessary remedial actions rn acca.rdance with En�iranm�nta.1 Law.
