200004452 <br />proper governmental entity to effectuate the intent of this <br />agreement. Buyer further agrees to request from such entities to <br />redraft and straighten the existing boundary line between Lots 8 <br />and 9 of the Amick Acres West Subdivision. Said subdivisions agree <br />to cooperate with Buyer's attempt to effectuate the intent of this <br />agreement before the proper governmental entities. <br />9. Conveyance at time of Closing: upon the closing, Seller shall <br />convey the two certain easements above - described to the Buyer in a <br />form satisfactory to Buyer and Buyer shall thereupon be entitled to <br />access of the real estate described above via Sonja Drive. <br />10. Condition of Premises: Buyer has made a personal inspection <br />and investigation of the premises and have entered into this <br />agreement based upon such personal inspection and investigation, it <br />being understood that neither the Seller nor any agent of the <br />Seller, has made any representations or warranties of condition to <br />the Buyer. Buyer agrees to plant a living barrier, including pine <br />trees or shrubbery on and adjacent to the lot lines of Lots 8 and <br />9 of Amick Acres West Subdivision, in such sufficient amounts to <br />discourage motor vehicles from driving around any fencing <br />separating said two subdivisions. <br />11. Covenants. Dues, and Rights: The owners of said Lots 71 and 8 <br />shall abide by the covenants of both said subdivisions and in the <br />event of a conflict of covenants, the most restrictive provision of <br />either covenant shall be of force and effect. Further, the owners <br />of said lots are required to pay, presently and in the future, <br />annual dues to the Amick Acres East Homeowner's Association an <br />amount equivalent of other said subdivision's lot owners. The <br />owners of said Lots 71 and 8 shall maintain membership and be able <br />to exercise voting rights in Amick Acres West Homeowner's <br />Association and with no other subdivision. <br />3 <br />
