<br /> Pnssessivn and Use. Un�il the accurrence ❑fi an E�ent of Detaul�, Trustor may �1} remain �n possession and
<br /> cont�a!�fi�he Property; ��� use, vpera�e or manage the Proper�y; and �3} collect the Rents from the Proper�y.
<br /> Duty to Ma�ntain. Trusfior shall main�ain the P��perty in tenan�able c�nditivn and promp�ly perform all repairs,
<br /> replacemen�s, and main�enance necessary�❑preser�e i�s�a�ue.
<br /> Cvmpliance 11�ith Environmenta� Laws. Trus�ar represents and warrants ta Lende�-that: {'1} I�uring the period of
<br /> Trus�or's ❑wnership of the Property,there has been n❑ use, generation, manufa�ture, storage, treatmen�, dispvsal,
<br /> r�lease or threa�ened re�ease v� any Hazardous Substance by any persan �n, under, abau� nr �f�om the Proper�y;
<br /> {2} Trustor has no knowledge of, �r reasan �o bel�e�e -�ha�k there has been, except as pre�ivusly disclosed �a and
<br /> acknowledged by Lender En writing, {a� any 1�reach ❑r �i�[afiian v� any EnWirvnmental Laws, �b} any us�,
<br /> generation, manufacture, s�orage, treatment, disposa[, release or �hrea�ened release v� any Hazardous Substance
<br /> on, under, a�ou� ❑r �rom the Property 1�y any privr �wners ❑r occupan�s v� the �'roperty, ❑r {c} any actual or
<br /> threatened �itigation or claims of any kind by any person rela�ing to such mat�ers; and 43} Excepfi as preWiausly
<br /> disclvsed t� and acknowledg�d by Lend�r in wri�ing, �a} neither Trustar nor any tenant, contra�tvr, agen�ar other
<br /> authori�ed us�r o�the Proper�y shall use, gene�ate, manufactu�e, s�vre, �reat, dispose of or release any Hazard�us
<br /> Substan�e�n, under, about or�rom�he Property; and �b� any such acti�ity shall be conducted in campliance with
<br /> al! applicahle federal, sfia�e, and Ivcal �aws, regulatians and ordinances, inc�uding WI�}IDU� limitativn all
<br /> En�irvnmen�al Laws. Trusto�r authari�es Lender and its agents to enter upon �he Property to make such
<br /> inspectEons and t�s�s, at Trustor's expense, as Lender may deem appropriat� t❑ d�termine comp�iance vf the
<br /> Property wi�h this secfiion of the Deed ❑f Trust. Any inspec�ions or tes�s made by Lender shall he far Lender's
<br /> purposes ❑nEy and shall not be construed �❑ create any responsibility vr liabili�y on the par�of Lender�o Trustor�r
<br /> �o any oth�r person. The �epresentations and warranties contained herein are �ased ❑n Trus�or's due diligence in
<br /> in�esfiigating the Prvperty f�r Ha�ard�us 5ubstances. Trustar hereby ��} releases and waiWes any future c�aims
<br /> against Lender for indemnity or con�ribution in �he e�ent Trustv�- becomes liable for cEeanup or other- costs under
<br /> any such laws; and �2} agrees to indemnify, de�end, and hold harmless Lender against any and all claims, lasses,
<br /> liabilities, damages, penalt�es, and expenses which Lender may dire�tly ar indirectfy sustain o�-suf�er resulting from
<br /> a breach ❑f this section of�he Deed ❑f Trus� or as a consequence o� any use, generation, manufacture, s�orage,
<br /> disposal, refease ar threatened refease occurr�ng prior�o Trus�or's ownership or interes�in the Property, whether o�-
<br /> no� th� same was ❑r should ha�e been known to Trustor. The pra�isions of�his sec�ivn o� the ❑eed of Trust,
<br /> including the obligativn�o indemnify and defend, shall sur�i�e the payment of the lndehtedness and the satisfactian
<br /> and reconWeyance o�F the li�n ❑f fihis Deed o�Trus�and sha�i not be affec�ed hy Lender's acquisitian of any in�e�est
<br /> in the Property, whether 1ay for�clasure ar atherwise.
<br /> Nuisan�e, Vllaste. Trustar- shall not cause, conducfi vr permit any nuisance nor commi�, permit, vr suffer any
<br /> s#ripping of o�- was�e �n ❑r t❑ the Property or any por�ion of the Property. VlJithout limiting the generali�y of�he
<br /> fvregoing, Trustor will no� remo�e, �r grant�❑ any o�her party the right to remo�e, any fiimber, minerals �inc�uding
<br /> ❑il and gas}, �oal, clay, scorEa, soil, gra�ei or ro�k produ��s withau�Lender's prior written cvnsent.
<br /> Remo�al o�lmprovemen�s. Trustor shall nv�demolish❑r remo�e any Imprv�ements-�r�m the Real Property wi�hout
<br /> Lender's prior wri�ten �vnsent. As a canditivn�o the remo�al o�any lmpro�emenfis, Lender may require Trustvr�o
<br /> make arrangements satisfacto�y �o Lender to replace such Imprv�ements wsth Impro�ements vf at least equaE
<br /> �alue. .
<br /> Lender's Right�o Enter. Lender and Lender's agents and representati�es may enfier upan the Real Prvperty at all
<br /> reasonalale times to attend tv Lender's in�teresfis and to inspect the Real Property �or purposes o� Trustor's
<br /> �ompliance with�khe terms and conditions a�this ❑eed of Trust.
<br /> Compiiance wtth Governmentaf Requirements. Trustvr shall prompt[y comply wi�h all laws, ardinances, and
<br /> regulations, now or hereatker in effect, of a11 ga�ernmental authori�ies applicalale �❑ the use or accupancy ❑��he
<br /> Property, in��uding withaut limitatian, �he Americans 1Ni�h Disabilities A��. Trus�or may can�est in gvvd �aifih any
<br /> such law, v�-dinance, vr reguiativn and withhold campliance during any proce�ding, including appropr�ate appeals,
