200.03805 <br />LEASE <br />DATE: The date of this Lease is , 2001. <br />2. PARTIES: The parties to this Lease, who agree to all of the terms hereof, are: <br />(a) Landlord: KEA Investments — LLC, a Nebraska Limited Liability Company. <br />(b) Tenant: Kevin Lockhart d /b /a Lockhart Homes. s 2� <br />3. TERM. The term of this Lease is one year, commencing 2, 2001 and ending <br />December 31, 2002. Tenant shall have the option to extend this Lease for an additional <br />term of one year on the condition that either party shall have a right to cancel the lease <br />during the one -year extension period by giving the other party 60 days advance written <br />notice of cancellation. In order for Tenant to exercise the option to extend the Lease for one <br />yeg, (;nant must give Landlord notice of the exercise of the option to extend by <br />G 15, 2002. <br />4. PREMISES. Landlord is the owner of the real estate situated in the East '/Z of the <br />Northeast Quarter of Section 12- 11 -10, Hall County, Nebraska, more particularly described <br />on Exhibit "A" attached hereto and made a part hereof by reference. The lease premises <br />(herein called the "premises ") consists of all of the Landlord's premises described on Exhibit <br />"A ". The premises is located on the southeast corner of the intersection of US Highway No. <br />281 and Capital Avenue. Driveway access is off of Capital Avenue. <br />5. RENT. The total rent payable by the Tenant for the lease of this premises is the sum <br />of $45,600.00 for one year, subject to the terms of this Lease. The Tenant agrees to pay the <br />rent at the rent of $3,800.00 per month, in advance, beginning Q 2,2001. <br />6. USE OF PREMISES. Tenant will not use the premises for any usielxcept for <br />carrying on and conducting the business of selling manufactured homes. In that regard, <br />Tenant shall place a manufactured home on the northerly portion of the easterly 30 feet of <br />the Lessee's premises as a demonstration home and Landlord shall be permitted to use space <br />in the demonstration home for a sales representative's office. Tenant agrees to cooperate <br />with Landlord in making space available at reasonable hours for use of the sales <br />representative's office. <br />7. PREMISES ACCEPTED "AS IS ". Tenant acknowledges that Tenant has examined <br />and inspected the premises and accepts the premises as they were on the date of this Lease. <br />Tenant agrees to not obstruct the driveway entrance into the Landlord's premises. The <br />parties agree that Tenant can use the space on Landlord's premises commonly used for <br />customer parking in order to accommodate Tenant's customers and for ingress and egress to <br />Tenant's premises. However, in order to preserve the asphaltic concrete surface of the <br />Landlord's premises, Tenant agrees not to permit any vehicles, trucks or tractors heavier <br />
