B�rrnwer's Copy. Borrower shall be gi�en one copy of th�Note and�f this Security Instrument. <br /> 17. Transfer of the Property;Acceleration;Assumption. This loan may be declared immediately due and <br /> payable upon �ransfer of the property securing such loan to any transferee, unless fhe accep�ability of the <br /> assumption nf#he loan is estab�ished pursuant to Section 3714 of�hapter37,Title 38,United States Gode. The <br /> acceptabijity of any assumption shall also be sub�ect to the following additional pro�isions: <br /> �a} Funding Fee: A fee equal to one-half of 1 percent of the balance of this loan as of the date <br /> of transfer of the prop�rty shal� be payable at the time of transfer to the loan holder or its au#harized <br /> agent, as trus�ee for the Department of Veterans Affairs. If the assumer fails to pay this fee at the <br /> time af transfer, the fee shall constitute an additional debt t�that already secured l�y this instrument, <br /> shall bear interest at the rate herein pro�ided, and at the option of the payee of fhe indehtedness <br /> hereby secured or any transfere� thereaf, shall be immediately due and payable. This fee is <br /> autamati�atjy wai�ed if the assumer is exempt under the pro�isions of 38 U.S.C. 3729��}. <br /> �b} Processing �harge: Upon application for appro�al ta allow assumption of this Ioan, a <br /> processing fee may be charged by the loan holder or its authorized agent for determining the <br /> �redi#w�r-fhiness of�he a5sumer and subsequently re�ising the ho�der's ownership records when an <br /> appro�ed transfer is �ompleted. The amoun� of this charge shal� nflt exceed the maximum <br /> established by the Department of Veterans Affairs for a loan tfl which Section 3714 of Chapter 37, <br /> Titl�38, Unifed States Code applies. <br /> �c} Indemnity Liability Assumption: If this obligation is assumed, then the assumer hereby <br /> agrees to assume all of�he olaligations of the�eteran under the terms of the instruments creating and <br /> secur�ng th�Ioan. The assumer further agrees�o indemnify the Department of Veterans Affairs to <br /> �he extent af any claim payment arising from the guaranty or insurance vf the indebtedness�reat�d <br /> hy this instrument. <br /> If the acceptability of the assumption of this loan is not established for any reason, and Lender exercises <br /> its option to deciare all sums se�ured by this Se�urity Instrument immediately due and payable, .Lender shall <br /> gi�e Borrower n�ti�e of acce�eration. The notice shall pro�ide a period of not less than 34 days fr�m the date <br /> the nfltice is gi�en in accordance with Section 14 within which Borrower must pay all 5ums secured hy this <br /> Security �nstrumen#. If Borrower fails #o pay these sums prior to the expiration of this period, Lender may <br /> in�oke any r�medies permitted hy fhis Security Instrument without further no�i�e or demand tin Borrower. <br /> 18. Borrower's Right fo Reinstate After Ac�eieration. If Borrov►�er meets certain conditions, Borrawer shall <br /> ha��the right to ha�e enforcement of this Security Instrument discontinued at any time prior t�the earliest of: �a} <br /> fi�e days before sale of the Property pursuant to any power of sale contained in this Security �nstrument; �b} such <br /> ather period as Applicable Law might specify for the termination flf Borrawer's right ta reinstate; or �c�entry ❑f a <br /> judgment enfflrcing this Security Instrument. Those conditions are that BorrovWer: �a}pays Lender all sums which <br /> then would be due under this Secur�ty Instrument and the Note as if na accelerati�n had accurred;�b}cures any default <br /> of any other co�enants or agreements;�c}pays all expenses incurred in enforcing this 5ecurity Instrum�nt, including, <br /> but not limited to, reasonabie attorneys' fees, propert}� inspectian and�a�uation fees, and�ther fees incurred far the <br /> purpose of protecting Lend�r's interest in the Property and rights under this Security Instrumen�; and�d}takes such <br /> action as Lender may reasonably re�uire�o assure that Lender's interest in the Property and rights under thfs Security <br /> Instrument, and Borrower's obligation to pay the sums secured by this Security Instrument, shall continue unchanged. <br /> Lender may require that Barrower pay such reinstatement sums and expenses in one or mor�of the following farms, <br /> as selected by Lender: �a}cash;(b}maney order;�c�certified check,bank check,treasurer's ch�ck or cashier's�heck, <br /> pro�ided any such check is drawn upon an institution whos�d�pasi�s are insured by a federa�agency, instrurnentality <br /> ar entity;or�d}Electr�nic Funds Transfer.
