d. Television Aerials,Other Towers -- No exposed television aerials, or other radio antennas, or towers shall be erected, or used on any Tract. 12. Covenant Declared Void. If any of the covenants, restrictions or conditions set forth in this Agreement are declared void by a court of competent jurisdiction, the remaining covenants, restrictions or conditions shall not be affected, but shall remain in full force and effect. 13. Persons Subject to Restrictions; Modifications. a. Except for the authority and powers specifically granted to the Declarant, the Declarant, or any owner of a Parcel named herein, shall have the right to enforce by a proceeding at law or in equity, all reservations, restrictions, conditions and covenants now or hereinafter imposed by the provisions of this declaration to either prevent or restrain any violation or to recover damages or other dues of such violation. Nothing herein contained shall in any way be construed to impose any obligation, of any kind, upon the Declarant or any successor and assigns of the same, any liability, obligation or requirement to enforce this instrument or any of the provisions contained herein. Failure by the Declarant, or by any Owner of a Tract, to enforce any covenant or restriction herein conatined shall in no event be deemed a waiver of the right to do so thereafter. b. These covenants, restrictions and conditions are to run with the land and shall be binding upon all persons and all parties claiming ownership of Tract for a term of thirty (30) years from the date this Agreement is recorded after which time it shall be automatically extended for successive periods of ten (10) years. This Declaration may be amended by the Declarants, or any person, firm corporation, partnershiup, or entity designated in writing by the Declarants, in any manner which it may determine in its full absolute discretion for a period of ten (10) years from the date hereof. Thereafter, this Declaration may be amended by an instrument signed by the Owners of not less than seventy -five percent (75 %)of the Tracts of the Country Living Estates. c.
