d. Television Aerials,Other Towers -- No exposed television aerials, or other radio <br />antennas, or towers shall be erected, or used on any Tract. <br />12. Covenant Declared Void. If any of the covenants, restrictions or conditions set forth in <br />this Agreement are declared void by a court of competent jurisdiction, the remaining covenants, <br />restrictions or conditions shall not be affected, but shall remain in full force and effect. <br />13. Persons Subject to Restrictions; Modifications. <br />a. Except for the authority and powers specifically granted to the Declarant, the <br />Declarant, or any owner of a Parcel named herein, shall have the right to enforce by a proceeding <br />at law or in equity, all reservations, restrictions, conditions and covenants now or hereinafter <br />imposed by the provisions of this declaration to either prevent or restrain any violation or to <br />recover damages or other dues of such violation. Nothing herein contained shall in any way be <br />construed to impose any obligation, of any kind, upon the Declarant or any successor and assigns <br />of the same, any liability, obligation or requirement to enforce this instrument or any of the <br />provisions contained herein. Failure by the Declarant, or by any Owner of a Tract, to enforce any <br />covenant or restriction herein conatined shall in no event be deemed a waiver of the right to do so <br />thereafter. <br />b. These covenants, restrictions and conditions are to run with the land and shall be <br />binding upon all persons and all parties claiming ownership of Tract for a term of thirty (30) <br />years from the date this Agreement is recorded after which time it shall be automatically <br />extended for successive periods of ten (10) years. This Declaration may be amended by the <br />Declarants, or any person, firm corporation, partnershiup, or entity designated in writing by the <br />Declarants, in any manner which it may determine in its full absolute discretion for a period of <br />ten (10) years from the date hereof. Thereafter, this Declaration may be amended by an <br />instrument signed by the Owners of not less than seventy -five percent (75 %)of the Tracts of the <br />Country Living Estates. <br />c.
