<br /> under the Laan Documents; �d} mortgage insurance premiums, if any, ar any surns payable to
<br /> Lender in �ieu of the payment af mortgage insurance premiums in accordance with the Loan
<br /> Documents; and(e} any communit}r association dues,fees, and assessments tha�Lender requires�o
<br /> be escrawed,These items are called"E�crow It�ms," I shall promp�ly furnish to Lender all notices
<br /> of amounts to be paid under this section. I shall pay Lender �he Funds for Escrow ItemS unless
<br /> Lender waiWes my ohiigation to pay the Funds far any or all Escrow�tems.Lender may waive my
<br /> abligation to pay to Lender Funds for any or all Escrow I�ems at any tirne. Any such wai�er may
<br /> anly be in writing. In the e►vent of such waiver, I sha�l pay d�rectly, when and where payable, the
<br /> amounts due for any Escrow�terns far which payment of Funds has been waived by Lender and, if
<br /> Lender requires, shall furnish to Lender receipts err�dencing such payment within such�ime periad
<br /> as Lender may reyusre, My obligation to rnake such payments and fo pravide receipts sha�l for al�
<br /> purposes be deemed to be a covenan� and agreernent contained in the Loan Dacuments, as the
<br /> phrase"co�enant and agreement" is used in the Lvan Dacuments. If I am obligated to pay Escrow
<br /> Items directiy, pursuant to a waiver, and � fail to pay th� amount due for an Escrow Item, Lend�r
<br /> may exercise its rights under the L�an Documents and this Agreement and pay such amount and I
<br /> shall then be obligated to repay to Lender any such amount. Lend�r may reWoke the wai�er as ta
<br /> any or all Escrow Items at any time by a notice gi�en in a�cardance wi�h the Loan I�ocuments,and,
<br /> upon such re�ocation, I shall pay to Lender all Funds, and in such amounts,that are then required
<br /> under this sec�ian.
<br /> Lender may, at any time, collect and hold Funds in an amoun� �a} suff c�ent t� permi� Lender to
<br /> apply the Funds a�the�ime specified under the Real Estate Settlement Procedures Act�"RESPA"},
<br /> and {b} not to exceed the maxirnum amount a len�er can reauire under RESPA. Lender shall
<br /> est�mate the amount of Funds due an the basis af current data and reasonable estimates af
<br /> expenditures of fu�ure Escrow Items or ofherwise in accardance with app�icable law.
<br /> The Funds shall be held in an institution whose deposits are insured hy a federal agency,
<br /> insfrumentality, or entity (inGluding Lender, if Lender is an institut�an whose deposits are s�
<br /> �nsured}vr in any Federal Hame Loan Bank.L�nder shall apply the Funds to pay the Escrow Items
<br /> no later than�he time specified under RESFA. Lender shall not charge me for hdlding and applying
<br /> the Funds, annual�y analyzing the escrow ac�ount, ar �erifying the Escro� Iterns, unless Lender
<br /> pays me interest on the Funds and appjicable law p�rmz�s Lender tn make such a charge. Unless an
<br /> agreement is made in writing or applicable 4aw requires interest to be paid on the Funds, Lender
<br /> sha�l not be re�uired to pay me any interest or eamings on the Funds. Lender and I can agree in
<br /> writing, however, that interest shall be paid on the Funds.Lender sha�I pro�ide me,without charge,
<br /> an annual accaunting af the Funds as required by RESPA.
