I wil� pay �o Lender on the da� payments are due under the Loan <br /> Documents as amended by this Agreement, until the Loan is paid in fu�l, a sum �the "Funds"} ta <br /> pro�ide for payment of amounts due for: (a}taxes and assessments and other items whxch can aitain <br /> priority over fhe Mortgage as a Iien or encumbrance on the Property; �b} �easehold payments or <br /> ground rents on the Property, �f any; �c} prern�ums for any and all insurance reyuired by Lender <br /> under the Loan Documenf5; �d} mortgage insurance premiums, if any, or any sums payabl� to <br /> Lender in lieu of the payment of mortgage insurance premiums in accordanee with the Loan <br /> Documents; and�e}any community association dues, fees, and a.ssessments that Lender requir�s to <br /> be escrowed.These items are called"Escrow I�ems." I sha�i promptly furnish to Lender all notices <br /> of amounts to be paid under this secrion. I shall pay Lender the Funds for Escrow �tems unless <br /> Lender wa��es rny�bliga�ion ta pay the Funds for any or a1I Escraw Items. Lend�r may wai�e my <br /> obl igat�on to pay to Lender Funds for any or all Escrow Items at any time. Any such wai��r may <br /> only be in writing. In �he e�ent of such waiver, I shall pay direct�y, when and where payable, the <br /> amounts due for any Escrow I�ems for which payment of Funds has be�n wai�ed by Lender and, if <br /> Lender requ�res, shall furnish to Lender receipts e�idencing such payment within such time period <br /> as Lender may require. My obligatian to make such payments and ta pro�ide receipts shall for all <br /> purpases be deemed ta be a co�enan� and agreement contained in the Loan Documents, as the <br /> phrase"co�enant and agreement" is used in the Loan Documents. �f I am ohligated ta pay Escrow <br /> Ifems directly, pursuant to a wai�er, and i fail to pay the amount due for an Escrow Item, Lender <br /> may exercise its rights under the Loan Documents and this Agreement and pay such amount and I <br /> shall then be obl igated to repay ta Lender any such amount. Lender may re�oke the wai�er as to <br /> any or�11 Escrow Items a�any time by a notice g��en in accordance with the Loan Documents,and, <br /> upon such revocation, I shall pay to Lender alj Funds, and in such amaunts,that are�hen required <br /> under this section. <br /> Lender may, at any time, collect and hold Funds in an amount �a} sufficient to permit Lender �o <br /> apply the Funds at the�ime speeified under the Real Estate Sett�ement Procedures Act�"RESPA"}, <br /> and �b} not to exceed the maximum amount a tender can reyuire under RESPA. Lender shall <br /> es�imate the amaunt af Funds due on the basis of current data and reasonable estimates of <br /> expenditures of future Escrow Items nr otherwise in accordance with applicable law. <br /> The Funds shall be held in an institution whose deposits are insured by a federal agency, <br /> ins�rumentali�y, or en�ity �including Lender, if Lender is an insti�ufion whose deposits are so <br /> insured}or in any Federal Home Loan Bank.Lender shal� apply the Funds ta pay the Es�row�tems <br /> no later than the time specified under RESPA. Lender shall nnt charge me for ho�ding and applying <br /> the Funds, annually analyzing the �scrow account, or verifying the Escrow �tems, un�ess Lender <br /> pays me interesf on the Funds and applicable law permitis Lender ta rnake such a charge.Unless an <br /> agreement is made in wr�iting or applicable la�v reyuires inferest to be paid on the Funds, Lender <br /> sha�l not be required to pay me any in�erest or earnings on the Funds. Lender and I can agree in <br /> writing, howe�er, that interest sha[1 be paid on the Funds.Lender shall pro�ide me,wi�hout charge, <br /> an annual accounting of the Funds as required by RESPA. <br /> If there is a surplus of Funds held in escrow, as defined under RESFA,L�nder shall acc�unt to me <br /> for the excess Funds in accordance with RESPA.
