(H} Hazard�us Materials Defined. The term "Hazardous Materia�s" sha�I mean dangerous, toxic, ar ha.2ardaus poXXutants, contaminants, �hemicals, wastes, materials or substances, as defined xn or governed by th�pra�isx�ns of any En�ironmental Law. �I} Environrnenta� Law Def�n�d. The term "Environmental Law" sha�1 mean any federal, state or 1oca11aws, statute, �rd�nance, ru�e, regulatian, administration order, or permit now in effect or herexnafter enacted, perta�ning to the pu��ic health, safety, industrial hygxene, or the environmen�al candxt�ons on, under or about the Trust Estate. Sectxon 3.14. Water R�ghts. The Grantor shall abxde by al� statutes, ru�es, and regu�a�xons �f any and a�� f�deral, state, and loca� autihorities ha�ing jurisdi�tion a�er the use and distributxon �f water and water resources, and fi�rth�r co�enants and agrees not to transfer, se��, assign, ar relinquxsh the wat�r rights now held or hereafter acquired ca�ering or re�a�ed to the Trust Estate withaut the prior writ�en cansent of the F eneficiary. ARTI�LE IV. EVENTS �F DEFAULT AND REMEDIES �F THE BENEFI�IARY Sect�on 4.�1. E�ents of Default� Each�f the foXlowing sha11 be an "E�ent vf Default": (A} default sha11 be made �n the payment of any amount due under any �b�igat�on; (B} defau�t shaX� �e made xn the du� observance ar performance of any of the covenants, canditions �r aareements on the part of the Grantor, and, if such default shal.l be under S��tians 3.�5, 3.�7, or 3.�8 here�f, such defau�t shall continue for a period of thirty (30} days after written n�tice specxfyxng such d�fau�t and requiring the same to be remedied shal� have been gi�en to the Crrantor by the Benefxciary; ��} any representation or wanranty made by the Grantar herein, or in any cer�xficate, xnstrument or d�cument de�ivered hereunder, shal.�pr��e to be false or mis�eading xn any ma�enal respect on or as of the date made; (I]} an "Event �f Defauit" sha1X ha�e occurred under any Lease Document or, in the e�ent any Lease Dacument d�es n�t ��ntain specified "E�ents of Default," the �rantor shall breach or be in defau��of any Lease Documen�; and U01-��75 I 51-��0 g FCL NE 21�9
