201607705 <br />8. If any owner of the Lots described on Exhibit "A" attached hereto and <br />incorporated herein by reference or their heirs, devisees, personal representatives, successors, as- <br />signs or grantees, shall violate any of the restrictive covenants, restrictions and conditions herein <br />set forth, it shall be lawful for any other person or persons owning any of the Lots described on <br />Exhibit "A" attached hereto and incorporated herein by reference to prosecute such proceedings <br />at law or in equity against the person or persons violating or attempting to violate any such <br />restrictive covenants, restrictions or conditions and to prevent him from so doing or to recover <br />damages for such violations. <br />9. If any of the restrictive covenants, restrictions or conditions herein set forth are <br />violated and declared void by a court of competent jurisdiction, the remaining restrictive cove- <br />nants, restrictions and conditions shall not be affected, but shall stay and remain in full force and <br />effect. <br />10. This agreement and the faithful performance of the terms thereof shall be binding <br />upon the successors, assigns and grantees of the Owners, and upon the purchaser or purchasers of <br />the Lots described on Exhibit "A" attached hereto and incorporated herein by reference and their <br />heirs, devisees, personal representatives, successors, assigns or grantees. Any purchaser or <br />purchasers of the Lots described on Exhibit "A" attached hereto and incorporated herein by <br />reference and their heirs, devisees, personal representatives, successors, assigns or grantees agree <br />to this DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND <br />CONDITIONS FOR SUMMERFIELD ESTATES HOMEOWNERS' ASSOCIATION (North <br />Road and Grouse Boulevard) by acceptance of any conveyance of a Lot described on Exhibit "A" <br />attached hereto and incorporated herein by reference. <br />11. The Owners have joined in these restrictive covenants, restrictions and conditions <br />herein by addendums attached hereto and incorporated herein by reference. This agreement and <br />all addendums hereto together shall constitute one (1) agreement.
