201607705 8. If any owner of the Lots described on Exhibit "A" attached hereto and incorporated herein by reference or their heirs, devisees, personal representatives, successors, as- signs or grantees, shall violate any of the restrictive covenants, restrictions and conditions herein set forth, it shall be lawful for any other person or persons owning any of the Lots described on Exhibit "A" attached hereto and incorporated herein by reference to prosecute such proceedings at law or in equity against the person or persons violating or attempting to violate any such restrictive covenants, restrictions or conditions and to prevent him from so doing or to recover damages for such violations. 9. If any of the restrictive covenants, restrictions or conditions herein set forth are violated and declared void by a court of competent jurisdiction, the remaining restrictive cove- nants, restrictions and conditions shall not be affected, but shall stay and remain in full force and effect. 10. This agreement and the faithful performance of the terms thereof shall be binding upon the successors, assigns and grantees of the Owners, and upon the purchaser or purchasers of the Lots described on Exhibit "A" attached hereto and incorporated herein by reference and their heirs, devisees, personal representatives, successors, assigns or grantees. Any purchaser or purchasers of the Lots described on Exhibit "A" attached hereto and incorporated herein by reference and their heirs, devisees, personal representatives, successors, assigns or grantees agree to this DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD ESTATES HOMEOWNERS' ASSOCIATION (North Road and Grouse Boulevard) by acceptance of any conveyance of a Lot described on Exhibit "A" attached hereto and incorporated herein by reference. 11. The Owners have joined in these restrictive covenants, restrictions and conditions herein by addendums attached hereto and incorporated herein by reference. This agreement and all addendums hereto together shall constitute one (1) agreement. The Owners who have signed addendums attached hereto and incorporated herein by reference agree to be bound by this agreement notwithstanding the fact that other persons may have declined to sign an addendum to this agreement.
