201607705 No vacant Lot contained within the Properties shall be subject to an assessment hereunder until buildings or improvements are constructed thereon and such buildings and improvements are ready for occupancy. Except as otherwise provided herein in regard to vacant Lots within the Properties, the restrictive covenants, restrictions and conditions contained in this DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD ESTATES HOMEOWNERS' ASSOCIATION (North Road and Grouse Boulevard) relating to maintenance of the Lots within the Properties shall apply on the same basis to all Lots within the Properties. 5. The assessment levied by the Association shall be used exclusively for the following purposes: a. Maintenance and care of center islands on Grouse Road, maintenance and care of shrubs, vegetation, grass or landscaping within such center islands and acquisition and maintenance of facilities and equipment necessary to water the shrubs, vegetation, grass or landscaping within such center islands or otherwise maintain such center islands; b. Maintenance, repair and care of the sign for Summerfield Estates located on Grouse Boulevard at the west entrance to Summerfield Estates from North Road ( "the west sign ") including, but not limited to, the payment of any premiums of insurance on the west sign for Summerfield Estates; and c. Payment of any electric bill for the west sign for Summerfield Estates. The Association is specifically authorized hereunder to contract with any third party to manage the Properties or provide maintenance as provided herein. In the event that any maintenance or repair is caused through the willful or negligent act of any Owner, his or her family, guest or invitees, the cost of such maintenance shall be promptly paid by such Owner. 6. The Association and its employees and agents, shall have the right of access to any Lot contained within the Properties for the purposes of performing maintenance and repairs and otherwise performing its duties hereunder and is hereby granted a specific easement for such purpose. 7. These restrictive covenants, restrictions and conditions are to run with the land and shall be binding on all persons and all parties claiming ownership of the Lots described on Exhibit "A" attached hereto and incorporated herein by reference. 4
