5. That both of Decedent's sons are now deceased. James Patrick O'Nele, III passed away on October 24, 2013, and Michael L. O'Nele passed away on May 5, 2016. Affiant is the surviving spouse of Michael L. O'Nele and the court- appointed personal representative of the Estate of Michael L. O'Nele, Case No. PR16- f 51, pending in the County Court of Hall County, Nebraska. 6. The above - described real property is less than one - quarter of an acre of agricultural real property, and had a value of less than $2,000.00. The value of Decedent's interest in all real property in Decedent's estate located in the State of Nebraska does not exceed $25,000.00. 7. Thirty days have elapsed since the date of Decedent's death on December 27, 2008, as shown on the certified or authenticated copy of the Certificate of Death of Decedent which is attached hereto and incorporated herein by this reference as Exhibit A. 8. No application or petition for the appointment of a personal representative is pending or has been granted in any jurisdiction. Any inheritance tax owed as a result of Decedent's death was determined and paid as evidenced by the inheritance tax proceeding relating to Decedent at Estate of Mae O'Nele, Deceased, Case No. PRO9 -260 in the County Court of Hall County, Nebraska. 9. No other person or persons has or have a right to the interest of Decedent in the above- described real property. 10. Pursuant to Neb. Rev.
