That Mae Hein O'Nele, Decedent, died on December 27, 2008, a resident of Hall <br />County, Nebraska. <br />2. That Decedent, prior to her death, executed the Mae Hein O'Nele Trust dated <br />December 1, 1997 ( "Trust "). Decedent owned various tracts of real property in both Hall and <br />Merrick Counties, Nebraska, and all of these tracts were conveyed to Decedent's Trust with the <br />exception of the following described property, to wit: <br />Commencing at the Southwest Corner (SW) of the Northwest Quarter of the <br />Northwest Quarter (NWl /a NW1/4) of Section Two (2), Township Ten (10) North, <br />Range Nine (9) West of the 6 P.M., Hall County, Nebraska, running East on the <br />South side of said Northwest Quarter of the Northwest Quarter (NW /4 NW%) <br />seventy -nine (79) rods, running thence north at right angles eight (8) feet, running <br />thence west at right angles seventy -nine (79) rods to the west section line of said <br />section, thence south to the place of beginning. <br />The real property described in this paragraph was owned by Decedent in her name only on the <br />date of her death, and continues to be shown on the land records of Hall County, Nebraska in <br />Decedent's name only. <br />3. That Decedent was preceded in death by her husband Lloyd Elmer O'Nele. That <br />Decedent had two children who were both living at the time of her death. Decedent's children <br />were James Patrick O'Nele, III and Michael L. O'Nele. That Decedent's sons were the <br />successor trustees and beneficiaries of Decedent's Trust, and all of the other real property owned <br />by Decedent's Trust on the date of her death was conveyed to her sons as tenants in common <br />following Decedent's death. The above - described real property was inadvertently excluded from <br />Decedent's Trust, was not distributed to Decedent's sole heirs or beneficiaries (her two sons) and <br />remains in Decedent's name today. <br />4. That the sole heirs of Decedent and beneficiaries of Decedent's Trust were her <br />two sons, and the above - described real property passed to them upon Decedent's death as tenants <br />in common. Following the death of Decedent, the property was owned by James Patrick O'Nele, <br />III and Michael L. O'Nele as tenants in common.
