201607002 <br />NOW THEREFORE, in consideration of $1.00 and other valuable consideration and the mutual <br />covenants, promises, and agreements contained herein, the parties agree as follows: <br />1. EXTINGUISHMENT OF RIGHTS AGAINST REAL PROPERTY: The Easement is hereby <br />terminated, released, and extinguished. Notwithstanding anything herein to the contrary, this <br />termination of the Easement does not affect or apply to any real property other than the Real <br />Property described herein. <br />2. RELEASE OF RIGHTS AGAINST GRANTOR: Grantor hereby release, terminate, waive, <br />and disclaim any right, cause of action, or claim which Grantor have or may have against <br />Grantee with respect to the Easement or the Real Property. <br />3. RELEASE OF RIGHTS AGAINST GRANTEE: Grantee hereby releases, terminates, waives, <br />and disclaims any right, cause of action, or claim which Grantee has or may have against Grantor <br />with respect to the Easement or the Real Property. <br />4. OTHER DOCUMENTS: The parties agree to execute such other and further documents as <br />shall be deemed reasonably necessary to effectuate the terms and conditions of this Mutual <br />Release to Terminate Permanent Access Easement, and the Grantee shall bear the costs and <br />expenses of preparing and recording such documents. <br />5. FILING: Grantor shall be responsible for the filing of this Mutual Release to Terminate <br />Permanent Access Easement with the Hall County Register of Deeds and indexing against the <br />Real Property described herein. <br />6. COUNTERPARTS. This Mutual Release to Terminate Permanent Access Agreement may be <br />signed in one or more counterparts, which when taken together, shall constitute one and the same <br />Mutual Release. The parties may execute and exchange counterparts by means of facsimile or <br />electronic transmission and the parties agree that the receipt of such executed counterparts shall <br />be binding on the parties and shall be construed as originals. <br />[Remainder of Page Intentionally Left Blank.
