201607002 NOW THEREFORE, in consideration of $1.00 and other valuable consideration and the mutual covenants, promises, and agreements contained herein, the parties agree as follows: 1. EXTINGUISHMENT OF RIGHTS AGAINST REAL PROPERTY: The Easement is hereby terminated, released, and extinguished. Notwithstanding anything herein to the contrary, this termination of the Easement does not affect or apply to any real property other than the Real Property described herein. 2. RELEASE OF RIGHTS AGAINST GRANTOR: Grantor hereby release, terminate, waive, and disclaim any right, cause of action, or claim which Grantor have or may have against Grantee with respect to the Easement or the Real Property. 3. RELEASE OF RIGHTS AGAINST GRANTEE: Grantee hereby releases, terminates, waives, and disclaims any right, cause of action, or claim which Grantee has or may have against Grantor with respect to the Easement or the Real Property. 4. OTHER DOCUMENTS: The parties agree to execute such other and further documents as shall be deemed reasonably necessary to effectuate the terms and conditions of this Mutual Release to Terminate Permanent Access Easement, and the Grantee shall bear the costs and expenses of preparing and recording such documents. 5. FILING: Grantor shall be responsible for the filing of this Mutual Release to Terminate Permanent Access Easement with the Hall County Register of Deeds and indexing against the Real Property described herein. 6. COUNTERPARTS. This Mutual Release to Terminate Permanent Access Agreement may be signed in one or more counterparts, which when taken together, shall constitute one and the same Mutual Release. The parties may execute and exchange counterparts by means of facsimile or electronic transmission and the parties agree that the receipt of such executed counterparts shall be binding on the parties and shall be construed as originals.
