That portion of the Praject operated an the Land as a nursing <br /> home, intermediate caxe facility, board and �are hom�, assisted living facility, andlor <br /> any other healthcare facility authorized to receive insured mortgage financing <br /> pursuant to S�ction 23Z of the National Housing Act, as amended, inciuding any <br /> cornmercia� space included in the facility; <br /> a. As used herein, "HUI]" means th� U.S. I]epartment of Housing and Urhan <br /> I]evelopment, acting hy and through the S��retary af that department, in the <br /> capacity as insurer or halder of the L�an under the auth�rity of the Nat�onal <br /> H�using Act, as amended, the D�partm�nt of Hous�ng and Urban <br /> Development Act, as amended, or any other federal law or regulation <br /> pertaining to the Loan�r the Praject. <br /> b. As used herein, "Laan" means the indebtedness fr�m Debtor ta Secured Party <br /> evidenced by a Healthcare Facility Note insured by HUD �the "Nate"'� and <br /> secured by a martgage, deed of trust, deed to secure debt, �r security d�ed �the <br /> "Security Instrument"�. <br /> �. A5 US�CI rl��'�'lll� "Master Lease" means a master �ease in which the Hea�thcare <br /> Facility is aggregated with �ther HLTD-insured healthcare facilities and leased <br /> to a mast�r tenant. <br /> d. As us�d herein, "�perator" means, except as atherwise appraved by HUD, <br /> an sin le asset entity acceptab�e ta HLJD that operates the Healthcare <br /> Y � <br /> Facility, pursuant ta a lease, management agreement, operating agreement, or <br /> similar contract �i} with the Debtor, or �11} if the Healthcare Facility is <br /> aggregat�d with other health care faci�ities in canne�tion with a Master Lease, <br /> �vith the master tenant pursuant to the Master Lease.
