2� 1 ��5851 C�. Funds far Escrvw Items. I will pay to th� Lender on the day paym�nts are due under the Loan aocuments as amended by this Agreement, until the �oan is paid in fu11, a sum tthe "Funds"} tv prov�de far payment of amounts due for: {a� Taxes and assessments and other it�ms which can attai,n priority ove� the Mortgage as a lien or �n�umbrance on the Property; �b} Leasehold payments or ground rents on the Praperty, if any; �c} Prem�ums for any and a�i insurance required by �ender under the Loan Dacuments; �d} Mvrtgage insurance premiums in accordance with the Loan Documents; and te� Any community assaciation du�s, fee5, and assessments the L�nder requires to be es�row�d. These items are �all�d "Escrow Items". I shall prvm�t�y furnish tv L�nder al! natices of amounts to be pa�d under this Sectian 4.D. I shall pay Lend�r th� Funds for Escrow Items unless Lender wai�es my obligation tv pay the Funds for any or alf Escrow Items. Lender may wai�e my obligatinn to pay to Lender Funds for any or all Escrow Items at any time. Any such wai�e� rnay only be in writing. In the e�ent of such wai�er, I sha�l pay directly, wh�n and where payable, the amounts due for any Es�row Items for whieh payment of Funds has been wai�ed by Lender and, i# Lend�r requires, shal� furnish to Lender receipts evidencing such payment within su�h time period as Lender may require. My obligation to make sueh payments and to pro�ide receipts shai� for all purposes be deemed to be a �v�enant and agreement contained in the Loan Do�uments, as the phrase "co�enant and agreement" is used in the Loan Documents. If I am obligated to pay Escrow #tems directfy, pursuant to a waiver, and i fail to pay the am�unt due for an Es�r�w ltem, Lender may exercise its right under the Loan Documents and this Agreement and pay such amount and I sha�� th�n be obligated to repay to Lender any such amount. Lender may re�oke the wai�er as to any or all Es�raw Items at any time by a notice given in accordance with the Loan Document�, and, upon such re�ocation, I shall pay to Lender all Funds, and in suCh amaunts, that ar�th�n r�quir�d under this Section 4.D. Lender may, at any time, ca�#ect and hald Funds in an amount �a� Suffi�i�nt to �ermit Lender to apply the Funds at the time sp�cified under the Real Estate 5ettlement Procedures Act �"RESPA"�, and �b} Not ta exce�d the maximum amflunt a lender can require under RESPA. Lender sha�l estimate the amount of Funds due on the basis af eurr�nt data and �-easanabie estimates of expenditur�s vf future Esc�-ow Items ar otherwise in a��ordance with appli�able law. The funds shail be h�ld in an institution whose deposits are insured by a federal agency, instrumentality, or �ntity {including Lender, if Lender is an institut�on whose deposits are so insured} or in any Federal Home Laan Bank. L�nder shall apply th� Funds to pay the Escrow Items no later than the time sp�cified under RESPA. Lender shall not charge me for holding and applying th� Funds, annually analyzing the escrvw a�count, or �erifying the Escrow Items, unless Lender pays me interest on the Funds and applieable law permits Lender to make such a �harge. Unless an agreement is made in writing or appli�able law requires inter�st to be paid vn the Funds, Lender shall not be required ta pay me any interest or earnings on the Funds. Lender and I can agree in writing, however, that interest shall be paid on the Funds. �ender sha�! provide me, withvut �harge,an annual accounting of the Funds as required by RESPA. If there is a surplus of Funds held in escrow, as defined under RESPA, Lender shall account tv me for the excess #und� in ac�ordance with RESPA. !f there is a shortage of Funds held �n escrow, as defined under RESPA, Lender shall not�fy me as required by RESPA, and I shall pay to Lender the amount necessary to make up the shartage in acevrdance with RESPA, but in no mare than 1Z monthly payments. If the�e is a deficiency of Funds held in escrow, as defined under RESPA, �ender shall notify me as required by RESPA, and I shall pay tv Lender the amount n��ssary to make up the deficiency in accordance with RESPA, but in no more than 12 monthly payments.
