In the e�ent of such wai�er,Borrawer <br /> shall pay direct�y,when and where payable,the amaunts due far any Escrow Items for which <br /> payment af Funds has been wai�ed by Lender and, if Lender requires, shall furnish to Lender receipts <br /> evidencing such payment with�n such time period as Lender may require. Borrower's obligat�on to <br /> make such payments and tv pro�ide receipts shalt for ali purposes be deemed to be a co�enant and <br /> agreement contained in this Security Instrument,a�the phrase "co�enant and agreement" is used in <br /> Section 9. If Borrower�s obligated to pay Escrow Items direc�ly,pursuant to a wa��er,and Barrower <br /> fai ls to pay the amount due for an Escrow Item, Lender may exerc ise its rights under Section 9 and <br /> pay such amount and Borrower shall then be�biigated under S�ct�on 9 to repay to Lender any such <br /> amount. Lender shall est�mate the amount of Funds due on the basis of eurrent data <br /> and reasonab�e estimates af expenditures of future Escrow Items or otherwise in accordance with <br /> App�icable Law. <br /> The Funds shall be held in an institution whose deposits are ir�sured by a federal agen�y, <br /> instrumentality,�r entity�in.cluding Lender, if Lender is atl institution wh�se depasits are so �nsured] <br /> or in ar�y Federal Home Laan Bank.Lender sha�i app�y the Funds to pay the Escr�vW Items no lat�r <br /> than the time specified under RESPA. Lender shal�not charge B�rrower for hold�ng and applying the <br /> F unds,annually analyz�ng the escrow ac�our►t,or�eri fying the Es�row Items,un less Lender pays <br /> Borrower interest on the Fur►ds and Appiicable Lavv permits Lender to make such a charge.Unless an <br /> agreement is made in writ�ng or Applicahle Law requires interest to be paid on the Funds, Lender shall <br /> nat he required to pay B�rrower any interest or earnings on the Funds. Borrower and Lender can agree <br /> in writing,howe�er,that interest shall be paid on the Funds. Lender shall gi�e to Barrower,without <br /> charge,an annual accounting of the Funds as required by RESPA. <br /> If there is a surplus of Funds held in es�row,as def ned under RESPA,Lender shall ac�ount to <br /> Borrower far the excess funds in accordance with RESPA. If there�s a shortage of Funds he�d�n <br /> escrow,as defined under RESPA,Lender shai�notify Borrower as required by RESPA,and Borrower <br /> shall pay to Lender the amount necessary to make up the shortage in accordanee with RESPA,but <br /> in no more than 12 monthly payments. If there is a deficiency of Funds held in escrow,as defined <br /> under RESPA, Lender shall notify Borrower as requir�d by RESPA,and Borrower sha�l pay to Lender <br /> the amount ne�essary to make up the def iciency in accordance with RESPA,but in no more than I 2 <br /> monthly payments. <br /> iJpon payment in full of all sums secured�y this Se�urity Instrument,Lender shal�pramptly refund to <br /> Borrower any Funds held by Lender, <br /> 4.
