<br /> En�ironmental Laws. Trusto�- authori�es Lender and its ag�nts to enter upon the Prope�y �o make such
<br /> inspections and �es�ks, at Trusfor's expense, as Lender may deem appropriafe �o determine compIiance o� the
<br /> Property with this se�tion o� �he Deed of T�-us�. Any inspections or tests made by Lender shaII be for Lenderrs
<br /> purpo�es oniy and sha�I no�be construed to create any respan�ib�li�y❑r IiabiIity on the par�o�Lender t❑ Trustor or
<br /> fo any other person. The representa�ions and warranties contained herein are based on Trus��r's due diligen�e in
<br /> in�esfigafing fhe Property for Hazardous Substances. Trus�ar hereby �'f} re�eases and wai�es any fu�u�-e ciaims
<br /> against Lender�or indemnity v�- �on�ributi�n in the e�ent Trustor becom�s liable for cleanup or other- costs under

<br />� Nuisance, Waste. Trustor shall not causer conduct or permit any nuisance nor commit, permit, or suffer any
<br /> stripping af or was�e on or to �he Prape�ty or any portian ❑�F the Praperty. Withaut limit�ng the generality ���he
<br /> �aregaingr Tr�ustor will not remo�e, or gran�to any other party the righ�to remo�e, any timber, minerals {including
<br /> I oil and gas}, coa1, c1ay, scot�ia�sail, gra�e� or rock produc�s wi�hou�Lender-'s p�ior wri�ten consent.

<br />; Removal of Imprvvements. Trus�or shaI1 not demolish or remove any Improvements from�he ReaI Property wi�haut
<br />� Lender's prior�nrritten consen�. As a condition to fihe rema�a� ofi any Improvements, Lender may require Trus�ar�o
<br /> make arrangem�nts satisfactory to L�nder to �epIa�e such impro�ements with Impr-o�ements o� at least equal

<br /> Lender's Right to Enter. Lende� and Lender's agen�s and r�presentati�es may enter upan �he Rea� Praper�y a� aI1
<br /> reasonab�e times to at-tend ta Lender's interests and ta inspect �he Real Praperty �or purposes ofi Trustor's
<br /> compliance with the terms and conditians of this ❑eed o��rusf.
<br /> �ampiiance with �v�ernmental Requirements. Trus�or shall promptfy comply wi�h aII lawsr ordinanc�s, and
<br /> regulations, now ar hereaf�ker in effect, of aII go�ernmenta� authvrities appiicable �a �he use ❑t- occupancy o�fhe
<br /> Prope�ty. T�ustor may contes�in good faith any such law, ardinan�e, or reguia�ion and withhoId �ompliance dur�ng
<br /> any proc�eding. including appropria�e appeais, so lang as Trustor has no�ified Lender in writing prior�o doing so
<br /> and s❑ jong as, zn Lender`s sale opinion, Lender's inte�ests in the Property ar-e not jeopardized. Lender may require
<br /> Trus�or to post adequate security vr a surety hond, reasonably satis�actory ta Lender,�a pratec#Lender'� interes�.
<br /> Duty t❑ Protect. Trustor agre�s neither t❑ abandon vr Ieav� unat��nd�d the Prvperty. Trustar shalI do all other
<br /> acts, in addi�ion�o�hose acts se�farth above in this s�c�i�n, which fram the character and use af the Property are
<br /> r�asanably necessary to prot�c�and preserv�the Property.
<br /> DUE DN SALE- C�NSENT BY LENDER. Lender may, a� Lender's option, declare immedia�ely due and payable aII sum�
<br /> secured by�his ❑�ed of Trust upon fihe sale or trans�Fer, withaut Lender's prio�writ�en consent, af aII or any part a��he
<br /> Reai Property, ❑r any interest in�he ReaI Property. A "safe or transter" means the con�eyance of ReaI Property ar any
<br /> righfi, t�t1e ❑r interes� �n the Real Praperky; whe�her I�ga1, beneficiaf or equitabler whether �oluntary or in�aluntary;
<br /> whether by outrigh� sale, deed, installment sale can�rac�, �and contra�t, �ontract for deed, i�asehold in�erest with a
<br /> term greater than three {3} y�ars, iease-optivn cont�-act, or by saie, ass�gnment, ❑r t�ans�er o�F any bene��cial in�eres�in
<br /> ❑r�o any land trus� holding �itle to �he Real Property, or by any ❑ther method o� con�eyan�e of an in�erest in the Real
<br /> Property. Howerrer, this op�ian shall not be exercised by Lender if su�h �xer�ise is prohibi�ed by federal �aw ar by

<br /> TAXES AN❑ LIENS. The follawing pro�isions relating to �he #axes and Iiens on �he Property are part of this Deed af
<br /> Trust:
<br /> Payment. Trustor shaIl pay when due (and in all ev�n�s prior to delinquency} all taxes, spec�al�axes, assessmen�s,
<br /> charges {including water and sew�r}, fines and impositions l�vi�d against or an acc�unt of the Property, and shall
<br /> pay when due aII claims for wark done on or�or ser�ices rendered ar material �Fu�nished to the Property. Trustor
<br /> shall maintain the Property�Free af aII liens ha�ing priority o�er ar equal�o the interest of Lender under this Deed a�
<br /> Trust� excep� for the iien of �axes and assessmen�s n�� due, excep� �Far the Existing �ndebtedness referred to
<br /> be[ow, and excep�as o�herwise pro�ided in�his Deed of Trus�.
<br /> R�ght to Cvntesfi. Trustor may withhold payment of any tax, assessmen�, �r cla�m in conne�tion with a gaad �Faith
<br /> dispute o�er the obliga�ion ta pay, so Iong as LenderTs�nteresf in fhe P�operty is nof jeopardized. If a lien ar�ses or
<br /> is fi�ed as a result ❑f nonpayment, Trusfor sha�I wi�hin �ifteen [15� days after fhe ��en arises or, if a iien is ti�ed,
<br /> within fi�teen t��} days afte�-Trustor has n�tice of�he filing, secure the discharg� of�he lien, ❑r i� reques�ed by
<br /> Lender, deposi�with L�nder cash or a suf���ient corporate surety bond or othe�security sa�is�actary to Lender zn an
<br /> amoun�suf�icien�to dis�harge the lien plus any costs and attorneys' fees, ar other charges fha� cauld accrue as a
<br /> resui�of a farec��sur�or sale under the iien. in any��ntest,Trustor shall def�nd ifself and Lender and shalC satisfy
<br /> any adverse judgment before enforcement agains�the Property. Trustor sha�I name Lend�r as an additional obIigee
<br /> under any surety bond�urnish�d in the contes�proceedings.
<br /> E��dence af Payment. Trustor shall upon demand �urnish to Lender sa�isfac��ry evidence o�F payment of the�axes
<br /> ❑r assessmen�ks and shall au�horize the appropriate go�e�nmentaI of�icial �o deli�er to Lender a�any t�me a wrztken
<br /> s�a�emen�of�he taxes and assessmen�s against the Praperty.
<br /> Notice of��nst�uction. Trus�nr shaIl notify Lender a� Ieast�ifteen {�5} days be�ore any work is commen�ed, any
<br /> serrrices are furnished, or any materials are supplied ta �he Praperty, if any mechani�`s lien, materialmen's lien, or
<br /> ather Iien could be asserted an a�count of the work, ser�ices, ar mat�rials and �he �ast exceeds $1,Onn.aa.
