<br /> inspection� and tests, at Trustor's expense, as Lende� may deem apprvpriate to determine compIiance o� the
<br /> Property with this section o�F�he Deed o�Trus�. Any inspections or �ests made b�r Lender shaII be for Lender's
<br /> purpases only and shall nat be �onstr�ued to crea�e any respansibili�y ❑r Iiability on the part❑t Lender to Trustor�r
<br /> to any ofher person. The representatians and warran�ies contained her�in are bas�d on Trustor's du� diligence in
<br /> investigatzng th� P�operty fvr Hazardous 5ubstances. Trustar hereby {�} releases and wai�es any future cIaims
<br /> against Lender for- indemnity or contribution �n �he e�ent Trustor �ecomes liable fvr cleanup ar other CQStS under
<br /> any such iawsr and {2� agrees to indemnify� de-��nd, and hold harmless Lender against any and all claims, los�es,
<br /> liabilities, damages, pena��ties, and expens�s which Lender may dire�tIy or indire�tly sustain o�suf�e�resulting from
<br /> a breach of this sectian of the ❑eed of Trust ❑r as � consequence of any use, generation, manu-Fac�ure, s�orage,

<br /> Nuisance, Waste. Trustor shall no� caus�� canduGt ar permi� any nuisance nor �ommitr permi�, ar suffer any
<br /> stripping of ar was�e an or to �he Property or any portion of�he Property. Withnut Iimi�ing �he generality ❑f the
<br /> farego�ng� Trustor will no� remo�e, ar gran�ta any❑ther party the righ�to remo�e, any fiimber, minerals {including
<br /> o�l and gas}, coa�, ciayr scoria,soil, graW�l or rocl�produ�ts wa�ho�rt Lender`s prior written �onsent'.
<br /> Remvva� of[mpra�ements. Trustor shall no�demalish ar remove any Improvements�rom�he Real Praperty withou�
<br /> Lender's prior written cvnsen�. As a Gondi�ion to the removal of any Improvements, Lender may require Trustor t�
<br /> make arrangements satis�a��ory t� Lender to reptace such Impra�emen�s with Improvements of at Ceast equal
<br /> �alue.
<br /> Lender's Right to Enter. Lender and Lender's agen�s and representati�es may enter upon the Real Pr�perty a� aII
<br /> reasonabie times �o attend to Lender's interests and f❑ inspect th� R.eal P�operty for purposes of Trustor's
<br /> camRliance with�he terms and �onditions of�his Deed o�Trus�.
<br /> Cvmplian�e with Governmental Requirements. Trustvr shall pramptIy comply wi�h all laws, ❑rdinan�es, and
<br /> regulatians� now or hereafter in effec�, of aII go�ernmental authorifies applicabl� to fhe use ar occupancy of the
<br /> P�vperty, Trustor may contes�in good faith any such law� ordinance, or reguIat�an and wi�hhold compliance during
<br /> any pr�ceeding, inciuding apprapriate appeals� s� fong as Trustar has notifi�d Lender in writing prior �❑ daing so
<br /> and so long as, in Lender's so�e opinion, Lender's interests in�he Praperty are na�jeopardized, L�nde�-may require
<br /> Trustor to post adequate seGurity o�a surety band, reasonably satisfactary to Lender,�o prate��Lender�'s in�eresf.
<br /> Duty to Prote�t. Trusfor agrees neither t'❑ abandon vr Iea�e unat�ended the P�operty. Trus�or shai� do a!! other
<br /> actsf in addi�ion to those acts set�Forth abo�e in this section� which fram th� �harac�er and use❑f the P�operty a�e
<br /> reasanably necessary to prot�ct and preserve the Property,
<br /> DUE�N SALE-CDNSENT BY LEN�ER. Lende�may, at Lender's option, declare immediately due and payable a�I sums
<br /> secured by this Deed af Trus�upon the sa��ar transferr without Lender's prior written consent� o�a��or any part af the
<br /> R�aI Property, or any interest in�he fteal Property, A "sale ar transfer" means�he �on�eyanGe ❑fi Real Property or any
<br /> right, ti�le or interes� in �he Real Property; whether legal, beneficial or equitable; whether �oluntary o� in�olun�ary;
<br /> whether by outright saIe, de�d, inst�alImen� sale �on�ract, �and �antrac�, �ontract for deed� leasehoid interest with a
<br /> term greater t�an tF�ree �3� yea�s� Iease�op�ian con�ract, or by�ale� assignmen�, or trans�e�of any ben�tfcia� interest in
<br /> or to any land trusf holding titIe to the Real Property, o�- by any ❑ther method o� canveyance of an interest in the Real
<br /> Property. However, �his option shaI1 not be exercised by Lender if such exercise is prohibited by federal Iaw ❑�- by
<br /> Nebraska Iaw.
<br /> TAXES AND LIENS. The foIlowing p�o�isions relating �o the taxes and Iiens on the Properry a�e pa� of thi� Deed ❑f
<br /> Trus�:
<br /> Payment. Trustor shall pay when due {and in all e�ents priar to delinquen�y} a�l taxes� special taxes, assessments,
<br /> c�arges �including water and sewer}, ��nes and imposit�ons �e�ied a�ains�or on accaun�o�f the Proper-�yf a�d shall
<br /> pay when due a!f claims for work done �n or for senrices rendered ar material fiurnished to �he P�opei--ty. Trus�or
<br /> shall maintain�he Property firee af alI liens having priority over or equai to�he inferes�af Lender under�his Deed of
<br /> Trus�, except for �he lien of �axes and assessments no� due, except f�r the Exis�ing lndebtedness referred ta
<br /> be�aw, and except as �t�ervvise p�o�ided in th�s ❑eea��f Trust.
<br /> Right to Cantest. TrustQr may withhold payment of any�ax, assessm�nt, or claim in c�nnection with a go�d faith
<br /> dispute o�er the obligation to pay, so long as Lender's in�erest in�he Property is not jeopardized. Ifi a Iien arises❑r
<br /> is filed as a result af nonpayment, Trusto� shal� within �ifteen ��5} days after the �ien arises or, if a Iien is filed,
<br /> within fifteen {1 57 days after T�us�or has noti�e ❑f the filing, secure the disGharge o�the Iienf ar if requested by
<br /> Lender. deposi�wi�h Lender cash or a suffi�ient corpora�e surety band or❑ther security satisfactor�to Lender in an
<br /> amount su�ficient to discharge the Iien plus any cos�s and att�rneys' fees, or othe�charges that cvuid accrue as a
<br /> resui�af a foreclosure or safe under the Iien. ln any contes�,Trustar shalf defend itself and Lender and shall satisfy
<br /> any ad�erse judgment before enforcement agains�the Property. Trus�ar shall name Lender as an additional obligee
<br /> under any surety bond furnished in the cantes�proceedings.
<br /> Evid�n�e v�Payment. Trus�or shall upon demand �urnish to Lender sa�isfactary e�idence"of paymen� o�the taxes
<br /> or assessments and shar� a�thoriz� the appropriate go�ernme��a� officia] to d���ver#o LendeT at�any time a written
<br /> statemen�of the taxes and assessmenfs agains�the Property,
