200102877 <br />month during the term of this easement on or before the last day <br />of the month in which it becomes due or by (iii) notifying <br />Bosselman that this easement shall terminate at the end of any <br />given month. <br />3. Bosselman shall have the right to terminate this <br />easement in the event that Econ -O -Lux does not cure any breach <br />by it of any covenant herein contained as soon as possible after <br />receiving written notice of a breach which Bosselman reasonably <br />claims to be a threat to the health of people or animals or <br />within thirty (30) days after receiving notice of any non- health- <br />threatening breach. <br />4. Upon termination of this easement Bosselman shall have <br />the right to shut off the pipeline and to not accept any <br />discharge into it. <br />ARTICLE VI <br />General <br />1. Econ -O -Lux covenants to defend, indemnify and save <br />Bosselman harmless of any and all claims, demands, actions, <br />causes of action or other charges of liability or responsibility <br />made by any governmental agency or any other person or entity <br />made or threatened to be made against Bosselman, Inc. on account <br />of any alleged act or failure to act on the part of Econ -O -Lux <br />whether the allegation is well founded or not; provided, only <br />that Bosselman shall give Econ -O -Lux prompt notice of the <br />existence of any such claim or- threatened claim. <br />2. As further consideration for Bosselman's grant of this <br />easement Econ -O -Lux covenants that during the term of this <br />easement it will not sell or allow others to sell any gasoline, <br />diesel or other motor vehicle fuel or lubricating oil from the <br />real estate described on Exhibit "B" hereto. <br />3. This Wastewater Pipeline Easement hereby specifically <br />cancels and supercedes the agreement between the predecessors in <br />interest to the real estate described in Exhibits "A" and "B" <br />hereto which is recorded in the Office of the Register of Deeds <br />of Hall County, Nebraska, as Document 78- 008322 and which shall <br />not "have no further effect whatsoever. <br />4. The covenants herein made and the easement herein <br />granted shall be deemed to run with the land in favor of and <br />binding upon Econ -O -Lux and Bosselman and upon their respective <br />successors in interest and grantees of the real estate described <br />in the exhibits hereto and all persons and entities using the <br />real estate with the permission of Econ -O -Lux or Bosselman or <br />their respective successors or grantees.
