<br /> all applica�le federa(, state, and local laws, regulations and ❑rdinanc�s, including wi�hout limitation a��
<br /> En�ironmental Laws. Trustor authori�es Lende� and its agents ta enter upon the Praper�y to make such
<br /> inspec�ions and t�sts, at Trustor�5 expense, as Lender may deem appropriate to determine compli�nce of the
<br /> Prvper�y with this section o� the Deed o� Trust. Any inspections �r tests made by Lender shall be fr�r Lender's
<br /> purposes only and shal� not be construed to create any responsibility or liability on �he part of Lender ta Trustor o�
<br /> to any o�her person. The representations and warranties contained herein are based on Trustar's due diligen�e in
<br /> in�es�igating the Property for Ha�ardous Substances. Trustor hereby �1� releases and wai�es any #uture �iaims
<br /> against Lender for inderr�nity ar contribution in the e�ent Trustor becomes liable for cleanup or vther costs under
<br /> any such laws; and �2� agrees to indemnify, defend, and hold harmless Lender against any and all cfaims, losses,
<br /> fiabili�ies, damag�s, pena�t€es, and expenses which Lender may directly or indirectly sustain or suffer resuft�ng�rom
<br /> a breach of this section o��he Deed o#Trust or as a cansequence o� any use, generation, manufactur�, storage,
<br /> disposal, release or threatened release occurr�ng prior to Trustor's awnership ar int�rest in the Property, whether or
<br /> not the same was ar shau€d ha�e heen known ta Trustor. The p�o�isions of th�s section vf �he Deed of Trust,
<br /> including�he obligatian ta indemni�y and de�end, sha��sur�i�e the payment of the Indehtedness and the sa�isfa�tion
<br /> and recon�eyance�f the lien of this Deed af Trust and shaf� not �e a��ect�d by Lend�r's acquisition of any �nterest
<br /> in the Praperty, whether by foreclosur�r�r otherwise.
<br /> Nuisance, Waste. Trustor shall not caus�, c�nduct �r permit any nuisance nor commit, permit, or suffier any
<br /> stripping o� a� waste ara ar �❑ the Prop�rty �r any portion of the Property. VVithout fimiting the generality of the
<br /> �vreg�ing, Trustor will not remo�e, ar g�ant to any vther par�y the right to remo�e, any timber, minerals �including
<br /> oil and gas}, coal, clay, scoria, sail, gravel or ro�k pr�duc�s without Lender's prior written �ons�nt.
<br /> Remo�al vf impro�ements. Trustor shall no�demolish or remo�e any �mpro�emen�s from the Real Property without
<br /> Lender's prior written cansent. As a �ondition to the remo�al of any Impro�ements, Lender may require Trusta�to
<br /> make arrangements satisfactary t❑ Lender ta replace such Impro�ements with Impro�ements of a� least equa�
<br /> �a�ue.
<br /> Lender's Right ta Enter. Lender and Lender's agents and representati�es may ente� upan the Real Proper�y at all
<br /> reasonahle times to at�end to Lender's interests and to inspect the Reaf Prop�rty �ar purposes o� Trus�or's
<br /> complian�e with the terms and candi�ions ofi this Deed of Trust.
<br /> Comp��ance with Ga�ernmental Requirements. Trus�or shall promp#ly comply with all (aws, ardinances, and
<br /> regulativns, now or hereafter in effec�, of all go�ernmental authori�ies applicable to the use or oc�upancy �f the
<br /> Praperty, incfuding without limitation, tl�e Am�ricans Wi�h Disabilities Ac�. Trustor may cvntsst in goad faith any
<br /> such law, ordinance, or regu�ation and t�vithhold complian�e during any proceeding, including appropriate app�als,
<br /> so long as Trustor has noti�ied Lender�n writing prior to doing so and so Ivng as, in Lender's sole apinion, Lender's
<br /> interes�s in the Pr�perty are not jeopardi�ed. Lender may requir� Trustor to post adequa�e SBCurity or a surety
<br /> bond, reasonably satisfa�tory to Lende�, to prat�ct Lender's interest.
<br /> Duty t❑ Prvtect. Trustar agrees neither to abandon vr lea�e unattended �he Property. Trustor shall da all other
<br /> acts, in additivn ta�hose ac�ts set f�rth ab��e in this section, whi�h from the character and use �f the Property are
<br /> reasonably necessary�o prat�c�and preser�e the Praperty.
<br /> DIJE�N SALE-��NSENT gY LENDER. Lender may, a� Ler�der's op�ion, de�lare immedia��ly du� and payab�e a11 sums
<br /> secured by this De�d o�Trust upon �he sale or transfer, wi�hout Lend�r's prior written consen�, of all ar any part vf the
<br /> Real Property, or any inter�st �n th� Real Property. A "sale or transfer" means the can�eyance of Real Prop�rty or any
<br /> riyht, ��tle �r in�erest in the Real Property; whether legai, bene�icia� ar e�uitab�e; whether �aluntary nr in�oluntary;
<br /> whethe� by outright sale, deed, �nstallment safe contract, land contract, contract for deed, leasehald interest with a
<br /> term gr�at���han three 43� years, �ease-op�ivn contract, or by sal�, assignment, or transfer v�any b�neficial interes� �n
<br /> or�o any land trust hv�ding title �o the Real ?roper�y, or by any o�her method of �an�eyance of an interest in the Real
<br /> Proper�y. Howe�er, �his vption shall not be exer�ised by Lender �f such exer�ise is prohibited by federa� law or by
<br /> Nebraska law.
<br /> TAXES AND LIENS. The following pro��sions �e�ating to the taxes and �iens an the Praperty are part of �his Deed o�
<br /> Trust:
<br /> Payment. Trustor shall pay when due �and �n all e�ents prior to delinquencyy all taxes, speciai tax�s, assessmen�s,
<br /> charges �in�luding water and s�wer}, tir�es and impasitions le�ied against or on a��ount af the Propert��, and shall
<br /> pay when du� all cfaims �ar work dnne on or far ser�ices rendered or material furnished �o the Property. Trustor
<br /> shall maintain the Pr�perty free o�al( liens ha�ing prio�ity o�er or equal to the interest of Lender under this Deed of
<br /> Trust, except for the lien of taxes and assessments n�t due and ex�ept as oth�rwise pro�ided in this ❑��d o�
<br /> Trust.
<br /> R�ght to Contest. Trustor may withhold paymen�of any tax, assessment, or claim in connect�on w�th a good faith
<br /> dispute o�er the ohligatian ta pay, sv [ang as Lender's interest in the Property is no�jeopardized. I�a lien arises ar
<br /> is filed as a resuft v� nonpayment, Trustor shall within fifteen {�5} days af�er the lien arises or, if a lien is �iled,
<br /> within fif�een �15y days a�ter Trustor has noti�e of the filing, secure the discharge ofi the lien, or if r��uested by
<br /> Lender, depasi�with Lender cash or a su��icient�orporat� sur�ty bond vr vther security satis#a��ory to LPnder in an
<br /> amaunt suffi�ien��o discharge ths lien p[us any costs and attorneys' �ees, ar ather charges that cauld a�crue as a
<br /> resu�t o�a �foreclasure or sale under the lien. In any cont�st, Trust�r sha�l defend itse��and L�nder and shall satisfy
<br /> any ad��rs�judgment before enfarcement against the Property, Trustor shall name Lender as an additional obligee
<br /> under any su�ety bond #urnished in�he cnnt�s�proceedings.
<br /> Evidence of Payment. Trustar shall upon demand �urnish ta Lender sa�isfactory e�idence of payment o�th� taxes
<br /> or assessments and shal� autho���e �he appropriate go�ernmental official ta deli�er to Lender a� any tim� a written
<br /> statement of�he�axes and assessments against the P�operty.
<br /> Nvt'rce o� Cvnstru�tian. Trust�r shall nc�tify Lender at feast fift��n {15� days he�ore any work is �ammPnced, any
<br /> ser�ices ar� furnished, or any materials are supplied to the Praperty, if any mechanic's lien, materialmen's �ien, or
<br /> o�her lien cou�d be asserted on accoun� o� �he wark, ser�i�es, or materials. Trustor wifl upan request of Lender
<br /> furnish to Lender advan�e assurances sa�isfa�tory �o Lender �hat Trus�or can and wili pay the cast af su�h
<br /> impro�ements.
<br /> PR�PERTY DAMACE INSURANGE. The #�i�awing prv�isions relating to insuring the Property are a part o�th�s De�d of
<br /> Trust.
<br /> Maintenance of Insuran�e. Trus�or sha�l pro�ur� and maintain po��cies of �ire insurance with s�andard extended
<br /> co�erage endorsem�nts an a repla�em�nt hasis for �he fulf insurabfe �a�ue co�ering all Impro�emen�s an �he Real
<br /> Property in an amount suffi�ien� #v a�oid application o� any �oinsurance c�aus�, and with a standard mortga�ee
<br /> clause in fa�or o�Lender. Trus�or shall also pracure and maintain camprehensi�e general liability insurance in such
<br /> co�erage amounts as Lender may request wi�h Trustee and Lend�r b��ng named as addi�ional insureds �n such
<br /> �iability insuranc� policies. Additionally, Trustor shalf mainta€n such flther insurance, including but n�t limited ta
<br /> hazard, business interrup�ion, and boiler insuranc�, as Lend�r may ��asona��y require. Policies shall be wr�tten in
