200003380 <br />without limitation, access standards relating to wheelchairs, doors, <br />entrances, and lavatories, shall be promptly completed by the <br />Mortgagor in accordance with the requirements of the ADA with <br />respect thereto. <br />(b) In the event that the Mortgagor undertakes any alterations, <br />modifications, or additions to the Improvements, the Mortgagor, at the <br />Mortgagor's expense, shall comply with all of the applicable <br />requirements of the ADA, including the construction requirements <br />and specifications of the ADA with respect thereto, and will obtain all <br />licenses and permits necessary to construct, use and operate the <br />Improvements, as so altered. <br />(c) The Mortgagor, at the Mortgagor's expense, (i) shall comply promptly <br />with the laws, ordinances, rules, regulations and orders of all <br />governmental authorities in effect from time to time that shall impose <br />any duty on the Mortgagor with respect to the Improvements or the <br />construction, alteration, use, occupancy,. and operation thereof, <br />including, without limitation, the ADA and the Federal Occupational <br />Safety and Health Act of 1970, (ii) will obtain any and all licenses and <br />permits necessary for any such use, and (iii) cause the Improvements <br />to be continuously in compliance with such laws (as the same may be <br />amended from time to time). <br />(d) The Mortgagor agrees to indemnify and hold the Mortgagee harmless <br />from any claims, losses, costs, fines, penalties, damages or other <br />expenses (including, without limitation, architectural, engineering, <br />legal and accounting fees) arising from any breach of the foregoing <br />representations, warranties and agreements. In the event that the <br />Mortgagee shall become the owner of the Collateral or any part <br />thereof by foreclosure or deed in lieu of foreclosure of this Mortgage, <br />the foregoing indemnification obligation shall survive such foreclosure <br />or deed in lieu of foreclosure. <br />III. DEFAULTS AND REMEDIES. <br />A.
